論我國(guó)弱勢(shì)群體權(quán)利保障制度之完善

【摘要】：弱勢(shì)群體的權(quán)利保障問(wèn)題,涉及社會(huì)公平正義價(jià)值觀的實(shí)現(xiàn),在任何國(guó)家都是一個(gè)值得重視的問(wèn)題。在這方面,隨著改革開(kāi)放的進(jìn)程,我國(guó)已取得了巨大的成績(jī)。但從制度等深層次審視,我國(guó)弱勢(shì)群體權(quán)利保障方面還存在諸多問(wèn)題。這些問(wèn)題,既涉及國(guó)家在法律、政策及社會(huì)體系方面的頂層設(shè)計(jì),又涉及弱勢(shì)群體法定權(quán)利的確定、實(shí)現(xiàn)以及救濟(jì)等具體制度的完善與改革。保障弱勢(shì)群體的正當(dāng)合法權(quán)益,我們還有很長(zhǎng)一段路要走。應(yīng)制定一部保障弱勢(shì)群體權(quán)益的基本法,確定弱勢(shì)群體保障制度的基本原則,形成以平等權(quán)、生存權(quán)、發(fā)展權(quán)為核心的人權(quán)標(biāo)準(zhǔn)體系,確保弱勢(shì)群體既有利益表達(dá)渠道通暢,同時(shí)開(kāi)拓新的利益表達(dá)機(jī)制,使該群體的利益和尊嚴(yán)能在不久的將來(lái)獲得更為充分的保護(hù)。
[Abstract]:The protection of the rights of the vulnerable groups, which involves the realization of the values of social equity and justice, is a problem worth paying attention to in any country. In this regard, with the reform and opening up process, China has made great achievements. However, there are still many problems in the protection of the rights of vulnerable groups in China. These problems not only involve the top-level design of national law, policy and social system, but also involve the determination, realization and improvement and reform of the legal rights of vulnerable groups. We still have a long way to go to protect the legitimate rights and interests of vulnerable groups. We should formulate a basic law to protect the rights and interests of the vulnerable groups, determine the basic principles of the security system for the vulnerable groups, and form a human rights standard system with equal rights, the right to exist and the right to development as the core, so as to ensure that the existing interests of the vulnerable groups have a clear channel of expression. At the same time, new mechanisms of interest expression can be developed so that the interests and dignity of this group can be fully protected in the near future.
