【摘要】：醫(yī)保契約,即醫(yī)保協(xié)議,是指基本醫(yī)療保險經(jīng)辦機構(gòu)(簡稱醫(yī)保機構(gòu))為實現(xiàn)對被保險人的醫(yī)療服務(wù)給付,而與醫(yī)療機構(gòu)及醫(yī)藥零售機構(gòu)簽訂的協(xié)議。醫(yī)保契約是實施基本醫(yī)療保險的基本方式,是規(guī)范醫(yī)保機構(gòu)與醫(yī)療機構(gòu)(包括醫(yī)藥零售企業(yè))關(guān)系的主要載體,對維護基本醫(yī)療保險之被保險人正當(dāng)利益與權(quán)利,規(guī)范醫(yī)療機構(gòu)的醫(yī)療供給行為,促進醫(yī)保服務(wù)水平的提高,推動我國基本醫(yī)療保險乃至整個醫(yī)療衛(wèi)生制度的發(fā)展,具有非常重要的意義。然而,理論上對醫(yī)保契約尚缺乏研究,實踐中對醫(yī)保契約的認(rèn)識比較混亂,制度上也未構(gòu)建起基本的醫(yī)保契約規(guī)則,不僅對當(dāng)下醫(yī)保制度的實施構(gòu)成不利影響,更是醫(yī)保制度長遠(yuǎn)健康發(fā)展的內(nèi)在障礙。本文基于對我國基本醫(yī)保運行的長期觀察,在充分調(diào)查研究的基礎(chǔ)上,分析了醫(yī)保契約的法律屬性,提出取消現(xiàn)存的定點管理制度實施契約管理,并對醫(yī)保機構(gòu)的監(jiān)管權(quán)與契約權(quán)、醫(yī)保契約中權(quán)利義務(wù)的配置、訂立與履行、被保險人權(quán)益保護、爭議的法律救濟等醫(yī)保契約法律制度進行了較為全面的研究,根據(jù)我國的國情和現(xiàn)實狀況以及我國基本醫(yī)療保障制度的發(fā)展趨勢,對醫(yī)保契約的諸多問題提出了建設(shè)性意見。
[Abstract]:Medical insurance contract, that is, medical insurance agreement, refers to the basic medical insurance agency (referred to as medical insurance agency) to realize the medical service payment to the insured, and the agreement signed with the medical organization and the pharmaceutical retail organization. Medical insurance contract is the basic way to implement basic medical insurance, it is the main carrier of standardizing the relationship between medical insurance institution and medical institution (including medical retail enterprise), and it can safeguard the legitimate interests and rights of the insured of basic medical insurance. It is of great significance to standardize the medical supply behavior of medical institutions, to promote the improvement of medical service level, and to promote the development of basic medical insurance and even the whole medical and health system in China. However, there is still a lack of research on the medical insurance contract in theory, the understanding of the medical insurance contract is confused in practice, and the basic medical insurance contract rules have not been constructed in the system, which not only has a negative impact on the implementation of the current medical insurance system. It is also an inherent obstacle to the long-term and healthy development of the health insurance system. Based on the long-term observation of the operation of basic medical insurance in China, and on the basis of full investigation and research, this paper analyzes the legal attributes of medical insurance contract, and proposes to abolish the existing fixed-point management system to implement contract management. It also makes a comprehensive study on the legal system of medical insurance contract, such as supervision right and contract right of medical insurance organization, allocation of rights and obligations in medical insurance contract, establishment and performance, protection of insurant's rights and interests, legal remedy of dispute, etc. According to the situation and reality of our country and the development trend of our country's basic medical security system, this paper puts forward some constructive suggestions on many problems of medical insurance contract.
