網(wǎng)絡(luò)購(gòu)物中的懲罰性賠償

【摘要】:網(wǎng)絡(luò)購(gòu)物環(huán)境下對(duì)于消費(fèi)者權(quán)益進(jìn)行侵害的案件屢見不鮮,經(jīng)營(yíng)者欺詐的手段也越來越多種多樣,網(wǎng)絡(luò)交易平臺(tái)的不作為使得消費(fèi)者維護(hù)自身合法權(quán)益的難度系數(shù)增大。而通過懲罰性賠償制度對(duì)經(jīng)營(yíng)者的不法行為予以一定懲戒,對(duì)消費(fèi)者在交易過程中所遭受的相關(guān)損失進(jìn)行賠償,最終遏制網(wǎng)絡(luò)交易過程中的不法行為,維護(hù)網(wǎng)絡(luò)交易安全。本文立足于網(wǎng)絡(luò)購(gòu)物中的各種侵權(quán)案件的現(xiàn)狀,共分為六章對(duì)網(wǎng)絡(luò)購(gòu)物中的懲罰性賠償進(jìn)行闡述。第一章緒論從選題背景及研究意義入手,介紹了在網(wǎng)絡(luò)購(gòu)物中適用懲罰性賠償制度的理論意義與司法實(shí)踐中的現(xiàn)狀。本文的創(chuàng)新點(diǎn)在于對(duì)懲罰性賠償制度在網(wǎng)絡(luò)購(gòu)物中的適用加以完善,對(duì)欺詐標(biāo)準(zhǔn)進(jìn)行明確,以及對(duì)網(wǎng)絡(luò)交易平臺(tái)的監(jiān)督責(zé)任加以確定。第二章懲罰性賠償制度的概述主要闡述了兩個(gè)部分:首先對(duì)懲罰性賠償制度的概念進(jìn)行了界定。在此基礎(chǔ)上分析并論述了網(wǎng)絡(luò)購(gòu)物環(huán)境下懲罰性賠償制度的特殊意義的功能與價(jià)值。其次從立法現(xiàn)狀進(jìn)行分析,介紹了我國(guó)關(guān)于懲罰性賠償制度的相關(guān)立法。第三章網(wǎng)絡(luò)購(gòu)物中適用懲罰性賠償?shù)恼系K介紹了三個(gè)典型案例:唯品會(huì)販賣假茅臺(tái)案、王某購(gòu)買手機(jī)被騙案、李某過期禮盒案。通過對(duì)案例的分析,闡述網(wǎng)絡(luò)購(gòu)物中適用的障礙,主要有:責(zé)任主體界定不明、欺詐存在特殊性、賠償金設(shè)置不合理。第四章網(wǎng)絡(luò)購(gòu)物中完善懲罰性賠償制度的必要性是對(duì)網(wǎng)絡(luò)購(gòu)物中完善懲罰性賠償制度的原因分析。通過完善適用懲罰性賠償制度,最終達(dá)到規(guī)范經(jīng)營(yíng)者的行為,保障消費(fèi)者的合法權(quán)益,維護(hù)網(wǎng)絡(luò)交易市場(chǎng)秩序的目的。第五章網(wǎng)絡(luò)購(gòu)物中完善懲罰性賠償制度的建議是針對(duì)以上分析所給出的建議。這些建議包括以下幾種:明確網(wǎng)絡(luò)交易平臺(tái)的監(jiān)督責(zé)任、明確“欺詐”的標(biāo)準(zhǔn)、合理確定懲罰性賠償金的計(jì)算方法以及建立有利于消費(fèi)者的程序性措施。第六章結(jié)論是對(duì)網(wǎng)絡(luò)購(gòu)物中完善適用懲罰性賠償制度的觀點(diǎn)進(jìn)行的進(jìn)一步的提煉,同時(shí)指出了本文在寫作過程中的不足之處。本文就我國(guó)網(wǎng)絡(luò)購(gòu)物消費(fèi)者權(quán)益保護(hù)進(jìn)行了法律分析,并提出了相應(yīng)建議措施,希望能對(duì)我國(guó)網(wǎng)絡(luò)購(gòu)物中消費(fèi)者權(quán)益保護(hù)工作的開展有所貢獻(xiàn),以促進(jìn)我國(guó)網(wǎng)絡(luò)購(gòu)物交易市場(chǎng)安全有序進(jìn)行。
[Abstract]:In the online shopping environment, the cases of infringement of consumers' rights and interests are common, and the means of fraud by operators are more and more diverse. The omission of online trading platform makes it more difficult for consumers to maintain their legitimate rights and interests. Through the punitive damages system to punish the operator of illegal behavior, to compensate consumers in the course of the transaction suffered by the relevant losses, and ultimately curb the illegal behavior in the course of online transactions, to maintain the security of online transactions. Based on the current situation of various tort cases in online shopping, this paper is divided into six chapters to elaborate punitive damages in online shopping. The first chapter introduces the theoretical significance of applying punitive damages system in online shopping and the current situation of judicial practice. The innovation of this paper is to perfect the application of punitive damages in online shopping, to clarify the standard of fraud, and to determine the supervisory responsibility of online trading platform. The second chapter summarizes the punitive damages system in two parts: firstly, the concept of punitive damages system is defined. On this basis, this paper analyzes and discusses the function and value of the punitive damages system under the network shopping environment. Secondly, it introduces the relevant legislation of punitive damages system from the analysis of the current situation of legislation. The third chapter introduces three typical cases in the application of punitive damages in online shopping: the case of VIPSHOP selling fake Maotai, the case of Wang Mou buying mobile phone and the case of Li Mou overdue gift box. Through the analysis of the case, this paper expounds the obstacles in the application of online shopping, such as the unclear definition of the responsible subject, the particularity of the fraud, and the unreasonable setting of the compensation. Chapter four: the necessity of perfecting the punitive damages system in online shopping is the analysis of the reasons for perfecting the punitive damages system in online shopping. By perfecting the system of punitive damages, the purpose of standardizing the operator's behavior, protecting the legitimate rights and interests of consumers and maintaining the order of the online trading market is achieved. The fifth chapter is the suggestion of perfecting punitive damages system in online shopping. These suggestions include the following: clear supervision responsibility of online trading platform, clear standards of "fraud", reasonable determination of the calculation method of punitive damages, and establishment of procedural measures in favour of consumers. The sixth chapter is a further refinement of the point of view of perfecting the system of punitive damages in online shopping, and points out the shortcomings of this paper in the process of writing. This article has carried on the legal analysis to our country network shopping consumer rights and interests protection, and has proposed the corresponding suggestion measure, hoped to have the contribution to our country network shopping in the consumer rights protection work, In order to promote our country network shopping transaction market safe and orderly.
