【摘要】：航空競爭的加劇導致飛機票的價格普遍下降,這讓普通大眾在出行時更愿選擇飛機出行,相比其他的交通方式,飛機出行也是較為安全的,當下選擇飛機出行已經成為常態(tài)。但是近年,尤其今年空難事故頻發(fā),引起了社會各界對空難賠償問題的熱烈關注。在空難發(fā)生后,大家關注的重點主要是受害者的賠償問題,而這里的受害者既有旅客也可能有地面的第三人,作為受害者可以獲得怎樣的賠償?本文是以旅客的賠償為主線,也簡單介紹了對地面人員的賠償問題,我國沒有專門的賠償法對空難中的人身損害賠償進行調整。就旅客的賠償來說,航空承運人的責任問題成為焦點,其中賠償限額存在的正當性也引起廣泛爭議,本文主要通過介紹空難發(fā)生后受害者及家屬涉及到的一些賠償問題,一次空難的發(fā)生,誰是事故的當事人,權利主體可得到的死亡賠償金性質是什么?賠償里是否包含精神損害賠償以及賠償限額存在的問題,發(fā)生空難事故時,航空保險有什么影響,通過相關問題的介紹來看到我國立法的不足,并通過介紹國際上的一些相關規(guī)定,以期對我國建立完善的空難人身損害賠償提供一些參考意見,從而為更好的解決實踐問題提供幫助。
[Abstract]:The increased competition in aviation has led to a general drop in the price of air tickets, which makes the general public prefer to travel by air, which is safer than other modes of transportation, and now it has become the norm to choose to travel by air. However, in recent years, especially this year, frequent air accidents have aroused great concern from all walks of life. After the air crash, the focus of attention is mainly on the compensation of the victims, and the victims here both passengers and possibly a third person on the ground, what kind of compensation can be obtained as victims? This paper takes the compensation of passengers as the main line and briefly introduces the compensation to ground personnel. There is no special compensation law in our country to adjust the compensation for personal injury in the air crash. As far as the compensation for passengers is concerned, the liability of the air carrier has become the focus, and the legitimacy of the limitation of compensation has also aroused widespread controversy. This paper mainly introduces some compensation problems involved in the victims and their families after the air crash. In an air crash, who is the party involved in the accident, and what is the nature of the death compensation that the subject of the right can get? Whether the compensation includes moral damage compensation and the problems existing in the compensation limit, what is the impact of aviation insurance in the event of an air accident, and through the introduction of related issues, we can see the insufficiency of our legislation. Through the introduction of some relevant provisions in the international, in order to establish a perfect air crash personal injury compensation to provide some reference advice, so as to better solve practical problems.
