【摘要】：個人數(shù)據(jù)保護法在為數(shù)據(jù)主體創(chuàng)設(shè)權(quán)利的同時,更要促進個人數(shù)據(jù)的合理流動,以推進大數(shù)據(jù)產(chǎn)業(yè)的發(fā)展。經(jīng)濟學(xué)分析表明,美國個人數(shù)據(jù)保護法比歐盟法更容易促進互聯(lián)網(wǎng)經(jīng)濟的快速增長。究其原因有三:寬松的個人數(shù)據(jù)保護法有利于社會總福利的增加;有利于發(fā)揮數(shù)據(jù)跨境流動與勞動力遷移的替代效應(yīng),降低社會費用;有利于發(fā)揮社會有序和無序的雙義作用,提升信息技術(shù)創(chuàng)新水平。有鑒于此并結(jié)合自身國情,中國宜選擇以社會經(jīng)濟優(yōu)先為導(dǎo)向的法律保護模式,即采取改良的"損害"進路,逐步健全個人數(shù)據(jù)保護法。
[Abstract]:Personal data protection law not only creates rights for data subjects, but also promotes the rational flow of personal data in order to promote the development of big data industry. Economic analysis shows that US personal data protection law is easier to promote the rapid growth of the Internet economy than EU law. There are three reasons for this: loose personal data protection law is conducive to the increase of total social welfare; it is conducive to giving play to the substitution effect of cross-border data flow and labor migration and reducing social costs; and it is conducive to bringing into play the social order and disorder. Improve the level of information technology innovation. In view of this and in combination with its own national conditions, China should choose the mode of legal protection based on social and economic priority, that is, to adopt an improved "damage" approach and gradually improve the personal data protection law.
