【摘要】：同一債權(quán)既有人的擔(dān)保又有物的擔(dān)保時,債權(quán)人是否有權(quán)選擇承擔(dān)擔(dān)保責(zé)任的主體?在擔(dān)保人承擔(dān)擔(dān)保責(zé)任之后能否向其他擔(dān)保人追償其應(yīng)承擔(dān)的擔(dān)保責(zé)任呢,且在內(nèi)部追償時各自的責(zé)任份額應(yīng)如何確定呢?解決此類問題還需我們對現(xiàn)行的法律進(jìn)行全面的梳理,以此找到解決之法。
[Abstract]:When the same creditor has both the security of the person and the security of the thing, does the creditor have the right to choose the subject of security liability? After the guarantor bears the security liability, can he or she recover the security liability from other guarantors, and how to determine the respective share of the responsibility in the process of internal recovery? To solve this kind of problem, we need to sort out the existing law comprehensively and find the way to solve it.
