【摘要】：正一段時(shí)期以來,網(wǎng)上和某些報(bào)刊上,向"狼牙山五壯士"、劉胡蘭、董存瑞、黃繼光、邱少云、雷鋒等英雄模范人物發(fā)難之聲,激起大量網(wǎng)民和讀者義憤。2016年10月,最高人民法院發(fā)布依法保護(hù)"狼牙山五壯士"等英雄人物人格權(quán)益典型案例(1)。今年3月頒布的《中華人民共和國(guó)民法總則》規(guī)定:"侵害英雄烈士等的姓名、肖像、名譽(yù)、榮譽(yù),損害社會(huì)公共利益的,應(yīng)當(dāng)承擔(dān)民事責(zé)任"(2)。這一切,合乎民意又恰逢其時(shí),促
[Abstract]:For some time now, the Internet and some newspapers and periodicals have been criticizing heroes and model figures such as "Langya Mountain," Liu Hulan, Dong Cunrui, Huang Jiguang, Qiu Shaoyun, Lei Feng, and so on, arousing righteous indignation among a large number of Internet users and readers. The Supreme people's Court issued a typical case of protecting the personality rights of heroes such as Langya Mountain, five strong Men, and so on (1). The General provisions of the Civil Law of the people's Republic of China promulgated in March this year stipulate that "whoever infringes the names, portraits, reputations, honours, and damages the public interests of heroes and martyrs shall bear civil liability" (2).
