論產(chǎn)品售后義務(wù)——兼評《侵權(quán)責(zé)任法》第46條
[Abstract]:It is a breakthrough in China's tort law to require manufacturers to bear after-sale obligations on products that have already been put into the market. Post-sales obligation originated from the correction of development risk defense under strict liability and has the important function of preventing damage and protecting consumer safety. The condition of after-sale obligation is that the manufacturer knows or should know that the product has defects, but the time point of defect (pre-sale or after-sale) does not affect the establishment of after-sale obligation. The tort liability arising from the breach of the post-sale obligation belongs to the fault liability, and the manufacturer shall not claim the development risk defense. The provision on the right to claim compensation for victims shall not be applied in cases of tort liability for breach of post-sale obligations.
