【摘要】：要求生產(chǎn)商對已經(jīng)投入市場的產(chǎn)品負(fù)擔(dān)售后義務(wù)是中國《侵權(quán)責(zé)任法》的一大突破。售后義務(wù)起源于嚴(yán)格責(zé)任下對發(fā)展風(fēng)險(xiǎn)抗辯的矯正,具有預(yù)防損害和保護(hù)消費(fèi)者安全的重要功能。售后義務(wù)以生產(chǎn)商知道或者應(yīng)當(dāng)知道產(chǎn)品具有缺陷為產(chǎn)生的條件,至于缺陷存在的時(shí)點(diǎn)(售前抑或售后)則不影響售后義務(wù)的成立。違反售后義務(wù)所產(chǎn)生的侵權(quán)責(zé)任屬于過錯(cuò)責(zé)任,生產(chǎn)商不得主張發(fā)展風(fēng)險(xiǎn)抗辯。關(guān)于受害者賠償請求權(quán)除斥期間的規(guī)定不應(yīng)在違反售后義務(wù)的侵權(quán)責(zé)任案件中適用。
[Abstract]:It is a breakthrough in China's tort law to require manufacturers to bear after-sale obligations on products that have already been put into the market. Post-sales obligation originated from the correction of development risk defense under strict liability and has the important function of preventing damage and protecting consumer safety. The condition of after-sale obligation is that the manufacturer knows or should know that the product has defects, but the time point of defect (pre-sale or after-sale) does not affect the establishment of after-sale obligation. The tort liability arising from the breach of the post-sale obligation belongs to the fault liability, and the manufacturer shall not claim the development risk defense. The provision on the right to claim compensation for victims shall not be applied in cases of tort liability for breach of post-sale obligations.
