孤兒作品的保護(hù)與使用問題研究

【摘要】：“孤兒作品”問題在國外早已引起了關(guān)注,針對“孤兒作品”的保護(hù)與使用,西方發(fā)達(dá)國家的學(xué)者已進(jìn)行了深入的研究,很多國家對此進(jìn)行了專門的立法。我國第三次《著作權(quán)法》修改草案(送審稿)于2014年6月被提請審議,其中對“孤兒作品”進(jìn)行了規(guī)定,這體現(xiàn)了我國對于“孤兒作品”問題的重視,也體現(xiàn)出我國順應(yīng)作品數(shù)字化的發(fā)展趨勢,對立法的積極完善。但是,盡管我國正在進(jìn)行對“孤兒作品”的立法嘗試,其具體規(guī)則仍然存在許多問題。鑒于歐盟、美國和加拿大對這些問題的研究以及立法相對來說比較全面,本文主要通過比較研究的方法,通過相關(guān)國外文獻(xiàn)的閱讀,對于其他國家和地區(qū)的立法及實踐進(jìn)行利弊分析,進(jìn)而借鑒其中符合我國制度體系的內(nèi)容,并結(jié)合《著作權(quán)法》修改草案(送審稿)的內(nèi)容,對于我國“孤兒作品”所涉及的著作權(quán)問題,提出一些具體細(xì)致的規(guī)則以及相關(guān)制度的完善建議。
[Abstract]:The problem of "Orphan works" has long aroused concern in foreign countries. In view of the protection and use of "Orphan works", scholars in western developed countries have carried out in-depth research, and many countries have made special legislation on it. The third revised draft of China's copyright Law (submitted for review) was submitted for consideration in June 2014, which stipulates "Orphan works", which reflects the importance our country attaches to the issue of "Orphan works". It also reflects the trend of digitalization of works and the positive improvement of legislation. However, although China is trying to legislate Orphan works, there are still many problems in its specific rules. In view of the relatively comprehensive research and legislation on these issues in the European Union, the United States and Canada, this paper mainly adopts the method of comparative study and the reading of relevant foreign literature. This paper analyzes the advantages and disadvantages of legislation and practice in other countries and regions, and then draws lessons from the contents which conform to the system of our country, and combines with the contents of the revised draft of the copyright Law (submitted for review). This paper puts forward some concrete and detailed rules and suggestions on the perfection of the relevant system for the copyright problems involved in Orphan works in China.
