【摘要】：隨著我國計(jì)算機(jī)技術(shù)的不斷發(fā)展,我國軟件的軟件產(chǎn)業(yè)越來越成熟。目前國內(nèi)軟件企業(yè)之間的競爭已經(jīng)由過去純粹功能上的競爭轉(zhuǎn)變?yōu)檐浖脩艚缑娴母偁?企業(yè)對于軟件用戶界面的知識產(chǎn)權(quán)保護(hù)需求日益增長。如今,我國的軟件企業(yè)都已經(jīng)意識到軟件用戶界面的重要性,都已經(jīng)投入了大量的人力和財(cái)力進(jìn)行軟件用戶界面的開發(fā),并取得了非常好的效果。但是,由于軟件用戶界面的開發(fā)成本高,侵權(quán)成本低,軟件用戶界面侵權(quán)現(xiàn)象難以杜絕。我國以騰訊、360為代表的軟件企業(yè)對于軟件用戶界面的知識產(chǎn)權(quán)保護(hù)需求越來越大,對軟件用戶界面的知識產(chǎn)權(quán)保護(hù)研究具有重要的理論和現(xiàn)實(shí)意義。本文首先介紹了我國軟件企業(yè)對于軟件用戶界面知識產(chǎn)權(quán)保護(hù)的需求,指出軟件用戶界面知識產(chǎn)權(quán)保護(hù)的重要意義。然后本文詳細(xì)分析了軟件用戶界面的基本特征和本質(zhì)屬性,分析了軟件用戶界面同作品、專利相比所具有的特殊屬性,指出現(xiàn)有的知識產(chǎn)權(quán)制度并不能對軟件用戶界面提供有效的保護(hù)。接下來,筆者介紹了國外軟件用戶界面的版權(quán)保護(hù)與外觀設(shè)計(jì)保護(hù)模式,結(jié)合我國現(xiàn)有的軟件用戶界面知識產(chǎn)權(quán)保護(hù)態(tài)勢,指出和分析國內(nèi)軟件用戶界面知識產(chǎn)權(quán)保護(hù)過程中存在的問題。最后筆者根據(jù)我國目前的實(shí)際情況,提出我國應(yīng)當(dāng)盡快完善軟件用戶界面的知識產(chǎn)權(quán)保護(hù)體系,給予用戶根據(jù)自身需求,自主選擇保護(hù)模式的權(quán)利。同時(shí)提出進(jìn)一步完善我國軟件用戶界面著作權(quán)保護(hù)制度、軟件用戶界面相關(guān)的發(fā)明專利保護(hù)制度及軟件用戶界面外觀設(shè)計(jì)保護(hù)制度的構(gòu)思和建議。
[Abstract]:With the development of computer technology, the software industry of our country is more and more mature. At present, the competition among domestic software enterprises has changed from pure function competition to software user interface competition, and the demand for intellectual property protection of software user interface is increasing day by day. Nowadays, the software enterprises in our country have realized the importance of the software user interface, and have invested a lot of manpower and financial resources to develop the software user interface, and have achieved very good results. However, due to the high cost of software user interface development and low cost of infringement, it is difficult to eliminate the phenomenon of software user interface infringement. The demand for intellectual property protection of software user interface (UI) in China is increasing for software enterprises represented by Tencent 360. It is of great theoretical and practical significance to study the IPR protection of software user interface (UI). This paper first introduces the demand of software enterprises for software user interface intellectual property protection, and points out the importance of software user interface intellectual property protection. Then this paper analyzes the basic characteristics and essential properties of the software user interface in detail, and analyzes the special properties of the software user interface compared with the works and patents. It is pointed out that the existing intellectual property system can not effectively protect the software user interface. Then, the author introduces the foreign software user interface copyright protection and appearance design protection mode, combined with the existing software user interface intellectual property protection situation, This paper points out and analyzes the problems existing in the process of intellectual property protection of software user interface in China. Finally, according to the actual situation of our country, the author puts forward that our country should perfect the intellectual property protection system of software user interface as soon as possible, and give users the right to choose their own protection mode according to their own needs. At the same time, the author puts forward some ideas and suggestions on how to further perfect the copyright protection system of software user interface, the invention patent protection system related to software user interface and the protection system of software user interface appearance design.
