【摘要】：生育,是人類種族延續(xù)的保障,它的發(fā)展經歷了特權、義務和權利三個階段。然而,生育權并非一朝一夕形成的,它是在經過不斷斗爭、形成權利觀念后繼而產生的。筆者在查閱相關資料后發(fā)現,目前我國尚未對生育缺陷者的生育權進行法律保護,甚至學界也從未對此問題進行過專門研究。另外,目前對夫妻生育權沖突的研究都是針對因主觀因素導致的生育權沖突而言的,對純粹因客觀因素(即生育缺陷)導致的生育權沖突未有涉及。本文中,筆者將借用醫(yī)學理論界定“生育缺陷”及“生育缺陷者”的概念,并在此基礎上,以主客觀因素為標準,對夫妻生育權沖突重新分類,通過引例分析我國現行法對生育缺陷者生育權保護的缺失之后,對比、借鑒國外在相關領域的先進立法,筆者將從完善我國婚姻法、規(guī)制人類輔助生殖技術和完善現行《中華人民共和國收養(yǎng)法》(以下簡稱《收養(yǎng)法》)對收養(yǎng)人的年齡限制三方面,為保護和實現生育缺陷者的生育權提出具有可操作性的法律對策。
[Abstract]:Fertility is the guarantee of the continuation of human race, its development has experienced three stages: privilege, obligation and right. However, the reproductive right is not formed overnight, it is through the continuous struggle, the formation of the concept of rights followed. After consulting the relevant data, the author finds that there is no legal protection of the reproductive rights of people with birth defects in our country at present, and even the academic circles have never made a special study on this issue. In addition, the current research on the conflict of husband and wife's reproductive rights is aimed at the conflict of reproductive rights caused by subjective factors, but not on the conflicts of reproductive rights caused by purely objective factors (i.e. fertility defects). In this paper, I will use medical theory to define the concepts of "birth defect" and "birth defect person", and on this basis, based on the subjective and objective factors as the standard, the conflict of husband and wife reproductive rights will be reclassified. Through the analysis of the lack of protection of the reproductive rights of the people with birth defects in the current law of our country, the author will perfect the marriage law of our country by comparing and drawing lessons from the advanced legislation of foreign countries in the relevant fields. Regulating the technology of human assisted reproduction and perfecting the current "Adoption Law of the people's Republic of China" (hereinafter referred to as "the Adoption Law") to regulate the age limit of adopters, In order to protect and realize the reproductive rights of persons with birth defects put forward operational legal countermeasures.
