【摘要】：隨著信息技術(shù)的日益進(jìn)步,大眾化數(shù)字音樂取代了以傳統(tǒng)媒介為載體的音樂,成為人們享受音樂精神食糧的新寵。然而大多數(shù)人并未意識(shí)到自己所享受的數(shù)字音樂,可能已經(jīng)侵害到創(chuàng)作人的版權(quán)利益。文章以《中國好聲音》陷入版權(quán)糾紛的案例,分析了目前我國大眾化數(shù)字音樂所面臨的版權(quán)方面的6個(gè)主要問題,并從公民意識(shí)、法律分析、利益分配以及新技術(shù)支持等4個(gè)方面提出了切實(shí)可行的建議,以期從根本上凈化大眾化數(shù)字音樂市場,真正起到有效保護(hù)數(shù)字音樂版權(quán)的作用。
[Abstract]:With the development of information technology, popular digital music has replaced the music with traditional media as the carrier, and has become a new favorite for people to enjoy music spiritual food. However, most people do not realize that their digital music may have infringed the copyright interests of their creators. In this paper, the author analyzes the six main problems of copyright in China's popular digital music by taking the case of "good Voice of China" into a copyright dispute, and analyzes it from the perspective of citizen consciousness and law. In order to purify the popular digital music market and protect the copyright of digital music effectively, the paper puts forward four feasible suggestions on the distribution of benefits and the support of new technology.
