【摘要】：違約責任與侵權(quán)責任的競合問題一直困擾著我國的司法實踐,如果把二者分開來看,無論是選擇違約亦或是侵權(quán)進行訴訟,從案件審理的角度來看,只要證據(jù)確鑿、有相應(yīng)的法律予以適用,案件的審理并不會很難。但是當一個案件既可以以違約責任起訴,又可以以侵權(quán)責任起訴時,如何選擇一個最有利于受害人的訴訟理由就成為了擺在我們面前的一個新的問題。本文從一個旅客運輸合同的案件作為切入點,深入分析了從不同的角度起訴的利與弊,主要運用對比的分析方法,希望可以為兩種責任的競合提出自己建設(shè)性的意見。第一部分根據(jù)作者在實踐中接觸到的一個旅客運輸合同案件入手,引出了其他類似案件都會引人思考的三個問題:即一個案件以違約為由進行訴訟時,是否可以侵權(quán)為由起訴,反之亦然;兩種責任起訴的利與弊是什么;二者的判決結(jié)果有何不同。第二部分是對違約責任與侵權(quán)責任的概述,從歷史的角度重看二者各自的發(fā)展歷史,介紹了違約責任與侵權(quán)責任競合的原因并介紹了具體的競合方式與學(xué)說。第三部分是介紹違約責任與侵權(quán)責任的區(qū)別以及兩種責任競合的現(xiàn)狀。兩者的不同主要體現(xiàn)在違約責任的歸責原則是以無過錯責任為主,過錯責任原則和過錯推定責任原則為輔;而侵權(quán)責任的歸責原則是以過錯責任原則為主,以過錯推定責任原則、無過錯責任原則和公平責任原則為補充。第四部分是本文的重點,作者結(jié)合案例具體談了在該旅客運輸合同中,從違約的角度和侵權(quán)的角度來看二者的競合問題,總結(jié)了分別以違約責任和侵權(quán)責任起訴對原告的利與弊。第五部分作者談到了違約責任與侵權(quán)責任競合的限制、責任競合制度的缺陷及彌補。
[Abstract]:The problem of concurrence between liability for breach of contract and liability for tort has been puzzling the judicial practice of our country. If we look at them separately, whether we choose breach of contract or tort for litigation, from the point of view of the trial of cases, as long as the evidence is conclusive. There is a corresponding law to apply, the case will not be very difficult to hear. However, when a case can be sued both by breach of contract liability and tort liability, how to choose the most favorable cause of action for the victim has become a new problem in front of us. This paper analyzes the advantages and disadvantages of prosecution from different angles from a case of passenger transport contract, mainly using the comparative analysis method, hoping to put forward their own constructive opinions for the two kinds of responsibilities. In the first part, according to a passenger transport contract case that the author has come into contact with in practice, it leads to three questions that other similar cases will think about: that is, whether a case can sue for infringement on the ground of breach of contract. Vice versa; what are the advantages and disadvantages of the two types of liability for prosecution; what are the differences between the two decisions? The second part is an overview of the liability for breach of contract and tort liability, from the historical point of view of the review of their respective development history, introduced the reasons for the concurrence of liability for breach of contract and tort liability, and introduced the specific ways and doctrine of concurrence. The third part introduces the difference between the liability for breach of contract and the liability for tort and the present situation of the concurrence of the two kinds of liability. The difference between the two is mainly reflected in the principle of liability for breach of contract, the principle of liability without fault, the principle of fault liability and the principle of presumption of fault, while the principle of liability for tort is the principle of liability for fault. It is supplemented by the principle of presumption of fault liability, the principle of no-fault liability and the principle of fair liability. The fourth part is the focus of this article, the author discusses the passenger transport contract, from the point of view of breach of contract and the perspective of infringement. The advantages and disadvantages of suing the plaintiff by breach of contract liability and tort liability are summarized respectively. In the fifth part, the author discusses the limitation of the concurrence of the liability for breach of contract and the liability for tort, and the defect and remedy of the system of the concurrence of the liability for breach of contract.
