文章摘要：有學(xué)者指出＂平等原則乃是憲法原則而非民法原則”、“我國(guó)《民法通則》第10條屬于錯(cuò)誤規(guī)定，應(yīng)予刪除”等，然則以馬克思主義為指導(dǎo)的社會(huì)主義民法理應(yīng)堅(jiān)持“平等原則”，重歸“中國(guó)法治自信”。從“平等原則”之實(shí)證考量及其方法論困境、國(guó)際國(guó)內(nèi)民商法的相應(yīng)立法、基本內(nèi)涵與判斷標(biāo)準(zhǔn)等方面出發(fā)，進(jìn)一步就合憲性、價(jià)值訴求、以人為本、基本原則的貫徹差異、法律的目的和國(guó)家利益及世界法學(xué)中的話語(yǔ)權(quán)等方面論證了“平等原則”之于我國(guó)民法的必要性與合理性。

Abstr：Some scholar pointed out that ＂the principle of equality is a constitutional law principle rather than the principle of civil law＂, ＂article 10 of General Principles of Civil Law is error regulation in our country, and should be deleted＂, etc.. However, guided by the Marxist, socialist civil law should adhere to the principle of e- quality, back to confidence on rule of law in China. From empirical considerations on the principle of equality and its dilemma of methodology, the corresponding legislation of international and domestic civil and commercial law, the basic connotation and judgment standards, etc. , this paper will further explore the differences among constitutionali- ty, value appeal, implementation of the basic principles of human-oriented, purpose of law, national interests, and voice sovereignty in the law world, and demonstrate that the necessity and rationality of the principle of equality is to civil law in our country.
