【摘要】：人格權(quán)在整個民法體系中占有核心地位。人格權(quán)的保障是民法研究的一個十分重要的部分,其所保障的客體正是法律的精神所在——人權(quán)。隨著時代的發(fā)展,人格權(quán)的內(nèi)涵得到不斷充實,外延在不斷延伸。從人格權(quán)的內(nèi)涵的角度來看,人格權(quán)的內(nèi)容包括人格權(quán)、隱私權(quán)、肖像權(quán)、姓名權(quán)等人身權(quán)利；從人格權(quán)的外延來看,隨著科技的進步,人格權(quán)的載體不斷擴展。當(dāng)今世界,互聯(lián)網(wǎng)科技造就了數(shù)字化時代。在虛擬世界中,人格權(quán)的概念在不斷得到強化,人格權(quán)的保護得到更多的重視。1995年我國開啟數(shù)字化時代以來,網(wǎng)絡(luò)的廣泛應(yīng)用改變了人們看待世界的方式和角度,影響了人們的思維方式和交往方式。網(wǎng)絡(luò)人格權(quán)的概念在我國法學(xué)界研究中不斷被引用,網(wǎng)絡(luò)人格權(quán)的侵權(quán)和保護問題得到了越來越多的重視。網(wǎng)絡(luò)人格權(quán)侵權(quán)是值得所有法學(xué)研究者關(guān)注的問題。研究網(wǎng)絡(luò)人格權(quán)侵權(quán)需從網(wǎng)絡(luò)人格權(quán)立法現(xiàn)狀出發(fā),仔細分析保障網(wǎng)絡(luò)人格權(quán)所面臨的問題,提出建立健全網(wǎng)絡(luò)人格權(quán)保護的設(shè)想,其對于保障每個公民的網(wǎng)絡(luò)人格權(quán),建設(shè)健康、和諧的網(wǎng)絡(luò)環(huán)境具有重要的理論價值和實踐意義。本文從傳統(tǒng)人格權(quán)的內(nèi)涵入手,理清網(wǎng)絡(luò)人格權(quán)的概念、特點；通過具體案例分析網(wǎng)絡(luò)人格權(quán)侵權(quán)形式與特點,對比國外網(wǎng)絡(luò)人格權(quán)的發(fā)展,結(jié)合目前我國對于網(wǎng)絡(luò)人格權(quán)保護的立法現(xiàn)狀,探究網(wǎng)絡(luò)人格權(quán)的保障制度。
[Abstract]:Personality right occupies the core position in the whole civil law system. The protection of personality right is a very important part of the study of civil law, and the object protected by it is the spirit of law-human rights. With the development of the times, the connotation of personality right has been constantly enriched and the extension has been extended. From the point of view of the connotation of personality right, the content of personality right includes personality right, privacy right, portrait right, name right and so on; from the extension of personality right, with the progress of science and technology, the carrier of personality right expands constantly. In today's world, Internet technology has created a digital age. In the virtual world, the concept of personality right is constantly strengthened, and the protection of personality right is paid more attention. Since 1995, the wide application of network has changed the way and angle of people to look at the world. Affected the way of thinking and communication of people. The concept of network personality right is constantly cited in the study of law circles in our country, and more attention has been paid to the infringement and protection of network personality right. The infringement of network personality right is a problem that deserves the attention of all legal researchers. To study the infringement of network personality right, we should proceed from the current situation of network personality right legislation, carefully analyze the problems faced by the protection of network personality right, and put forward the assumption of establishing and perfecting the network personality right protection, which can protect every citizen's network personality right. Building a healthy and harmonious network environment has important theoretical value and practical significance. Starting with the connotation of traditional personality right, this paper clarifies the concept and characteristics of network personality right, analyzes the forms and characteristics of network personality right infringement through specific cases, and compares the development of foreign network personality right. This paper probes into the protection system of network personality right according to the current legislative situation of network personality right protection in our country.
