【摘要】：人格權與人權的關系從根本上說是民法與憲法之間的關系,盡管分屬于不同的法律秩序,二者之間卻存在著密切的互動,人格權的基本化和基本權利的民事化是同時雙向發(fā)生的進程�；緳嗬麨槿烁駲嘀贫忍峁┖戏ㄐ詠碓匆约鞍l(fā)展與完善的動力;而人格權則落實對基本權利的保障,實現(xiàn)其客觀價值和主觀權利的雙重功能。人格權制度在當代主要回應"主體客體化"的風險,防止人由法律關系的主體淪為客體。從這個角度來看,《民法總則》的相關規(guī)定仍然存在不足,而傳統(tǒng)的侵權法來保護人格權的模式也難以有效應對當代的挑戰(zhàn)。強調(diào)人格權與人權之間的內(nèi)在聯(lián)系,以有效保護人格權的方式來切實推進人權保護,這是當代中國法典化所應承載的歷史使命,也是中國實現(xiàn)依法治國的必由之路。
[Abstract]:The relationship between personality and human rights is fundamentally the relationship between civil law and constitution. Although they belong to different legal order, there is close interaction between them. The basic right of personality and the civil nature of basic right are two-way processes at the same time. The basic right provides the legitimate source and the motive force for the development and perfection of the personality right system, while the personality right implements the protection of the basic right and realizes its dual function of objective value and subjective right. The system of personality right mainly responds to the risk of subject objectification in contemporary times, and prevents people from becoming object from the subject of legal relationship. From this point of view, the relevant provisions of the General principles of Civil Law are still inadequate, and the traditional tort law to protect the personality rights model can not effectively meet the contemporary challenges. To emphasize the internal relationship between personality right and human rights and to promote the protection of human rights in the way of effectively protecting personality rights is the historical mission that should be carried by the codification of contemporary China, and is also the only way for China to realize the rule of law.
