論公眾人物隱私權(quán)的限制與保護(hù)

【摘要】: 隱私權(quán)在美國等國家中作為一項獨立的人格權(quán)被加以嚴(yán)格保護(hù)。而在中國,由于歷史和現(xiàn)實的原因,對于隱私權(quán)認(rèn)識的程度和立法意識還有很大欠缺。對于公眾人物的概念尚存在分歧,更談不上對公眾人物隱私權(quán)的限制和保護(hù)的問題。因此,本文擬對隱私權(quán)及公眾人物的隱私權(quán)的基本概念,主體客體特征及學(xué)界關(guān)于公眾人物隱私權(quán)限制、保護(hù)的理論進(jìn)行分析,以公共利益為基本原則,具體從實踐上對于公眾人物隱私權(quán)保護(hù)與限制的標(biāo)準(zhǔn)進(jìn)行界定,從而對我國公眾人物隱私權(quán)的保護(hù)提出相關(guān)的立法、司法建議,旨在對我國公眾人物隱私權(quán)制度的建構(gòu)和完善有所幫助。 論文在對基本概念進(jìn)行闡述的基礎(chǔ)上采取逐步深入的分析方法,去粗取精,去偽存真,從而得出自己的結(jié)論。除引言和結(jié)語之外,論文共分五個部分對公眾人物隱私權(quán)的限制與保護(hù)展開論述。 第一部分隱私權(quán)概論。通過對隱私及隱私權(quán)概念的分析比較,認(rèn)為隱私是一種與公共利益群體利益無關(guān)的,當(dāng)事人不愿他人知道、干涉或他人不便干涉的個人私事和當(dāng)事人不愿他人侵入或他人不便侵入的個人領(lǐng)域。而隱私權(quán)是自然人享有的對其個人的與公共利益無關(guān)的個人信息、私人活動和私有領(lǐng)域進(jìn)行支配的一種人格權(quán)。隱私權(quán)的主體是生存的自然人,法人和死者不能成為隱私權(quán)的主體。隱私權(quán)的內(nèi)容為隱私保密權(quán)和隱私支配權(quán)。 第二部分公眾人物的隱私權(quán)。公眾人物是指在社會生活中廣為人知、具有相當(dāng)高的社會知名度的社會成員。將公眾人物區(qū)分為政治性公眾人物和其他社會公眾人物。判斷一個人是否為公眾人物的標(biāo)準(zhǔn)是他在一定區(qū)域內(nèi)被社會大眾的關(guān)注程度和熟悉程度。公眾人物與一般自然人相比,其隱私權(quán)具有強(qiáng)烈的吸引力、與公共利益的密切聯(lián)系性、知情權(quán)與隱私權(quán)沖突的必然性、與個人利益的沖突性的特征。 第三部分公眾人物隱私權(quán)的限制。綜合已有的研究成果,認(rèn)為對公眾人物隱私權(quán)進(jìn)行限制的原則為公共利益原則、公眾合理興趣原則、利益衡量原則和事業(yè)相關(guān)原則。在司法實踐中應(yīng)將上述幾種原則結(jié)合起來。以公共利益原則為核心,以公眾合理興趣原則為重點,以利益衡量原則、事業(yè)相關(guān)原則為輔助進(jìn)行整體性考慮。按照將公眾人物分為政治性公眾人物和社會公眾人物的分類方法,,在對公眾人物隱私權(quán)的限制上,應(yīng)采取區(qū)別對待的態(tài)度。 第四部分公眾人物隱私權(quán)的保護(hù)。首先分析公眾人物隱私權(quán)保護(hù)的必要性和可行性,然后指出保護(hù)的內(nèi)容,即被侵犯的內(nèi)容是對與社會公共利益無關(guān)的、純粹的私人生活安定的侵犯,對公眾人物私人空間的侵害,對公眾人物與社會或公共利益無關(guān)的個人信息的披露。 第五部分我國公眾人物隱私權(quán)保護(hù)現(xiàn)狀及立法建議。分析中國法律對公眾人物隱私權(quán)保護(hù)的現(xiàn)狀,發(fā)現(xiàn)存在立法缺位、立法水平滯后等問題。提出隱私權(quán)保護(hù)立法體系構(gòu)建的建議,即采用直接保護(hù)方式,健全隱私權(quán)保護(hù)法律體系,制定完善各專門法,對公眾人物隱私權(quán)要做出限制性、保護(hù)性及層次性規(guī)定,劃定核心保護(hù)范圍等。
[Abstract]:Privacy rights are strictly protected as an independent personality right in the United States and other countries. In China, due to historical and practical reasons, there is still a great lack of awareness of the right to privacy and legislative consciousness. There are still differences in the concept of public figures, not to mention the problem of limiting and protecting the right to privacy of public figures. Therefore, the basic concept of privacy and the right to privacy of the public figures, the characteristics of the subject and object and the theoretical analysis of the restrictions on the right to privacy of the public figures and the protection of the public figures are analyzed, and the basic principles of public interest are taken as the basic principle, and the standards for the protection and restriction of the privacy rights of the public figures are defined in practice. The relevant legislation and judicial proposals are proposed to protect the privacy of the public figures in China.
On the basis of the exposition of the basic concepts, the thesis takes a gradual and in-depth analysis method, and draws the conclusion from the rough, the false and the true. In addition to the introduction and conclusion, the thesis is divided into five parts to discuss the restrictions and protection of the privacy rights of the public figures.
The first part is an introduction to the right to privacy. Through the analysis and comparison of the concept of privacy and the right to privacy, it is considered that privacy is a kind of personal affairs that are not related to the interests of the public interest groups, the parties do not want others to know, interference or other people are inconvenient to interfere in personal affairs and individuals who are unwilling to invade or invade by others. The right of privacy is the natural person's enjoyment. There are personal information that is not related to the public interests, private activities and private fields. The main body of the right of privacy is the natural person living, the legal person and the deceased can not be the main body of privacy. The content of the right of privacy is the right of privacy and the right of privacy.
The second part of the public figure's right to privacy. The public figure is a social member known in social life with a fairly high social popularity. It distinguishes the public figures into political public figures and other public figures. The criterion for judging whether a person is a public figure is that he is in a certain area by the public. Compared with the general natural person, the privacy of the public figure has a strong appeal, the close connection with the public interest, the inevitability of the conflict between the right to know and the right to privacy, and the characteristics of the conflict with the personal interests.
The third part is the restriction of the right to privacy of the public figures. The principle of restricting the right to privacy of the public figures is the principle of public interest, the principle of public interest, the principle of interest measurement and the principles of cause. The principle of public interest in reasonable interest is the key point. The principle of interest measurement and the related principles of the cause are considered as a whole. According to the classification of public figures into political public figures and public figures, the different attitude should be taken to restrict the privacy of public figures.
The fourth part is the protection of the right to privacy of public figures. First, it analyzes the necessity and feasibility of the protection of public figures' right to privacy, and then points out the content of protection, that is, the content of the protection is irrelevant to the public interests, the pure private life and stability of the private life, the infringement of the private space of the public figures, the public figures and the society or the public. The fifth part of the protection of the right to privacy of public figures in China and legislative proposals. Analysis of the current situation of the protection of the right to privacy of the public figures in China, found that there is a lack of legislation and the lag of the level of legislation. The suggestions for the construction of the legislative system for the protection of the right to privacy, namely, the use of direct protection, the sound protection of the legal system of the right to privacy, have been formulated. Good laws should restrict, protect and level the privacy of public figures, delineate the core protection scope and so on.
