論房屋多重買賣中物權(quán)歸屬之判斷標(biāo)準(zhǔn)

【摘要】:房屋多重買賣現(xiàn)象在市場經(jīng)濟(jì)快速發(fā)展的影響下日趨增多,在交易過程中,出賣人基于房屋的高價(jià)值性、市場稀缺性以及剛性需求性等特點(diǎn)將同一房屋出售給多個(gè)買受人以尋求經(jīng)濟(jì)利益的最大化。然而,現(xiàn)行立法和司法解釋對于上述多重買賣現(xiàn)象中的實(shí)際履行順序及物權(quán)歸屬問題至今沒有明確的規(guī)定,雖然最高人民法院為指導(dǎo)正確適用法律處理房屋多重買賣中產(chǎn)生的權(quán)利糾紛擬定了相關(guān)規(guī)定,但是該規(guī)定的合理性仍存有一定的探討空間。有鑒于此,本文在分析房屋多重買賣特征、比較不同物權(quán)變動(dòng)模式下物權(quán)歸屬的判斷標(biāo)準(zhǔn)以及考察我國關(guān)于房屋多重買賣物權(quán)歸屬之判斷標(biāo)準(zhǔn)的司法實(shí)務(wù)和學(xué)說理論的基礎(chǔ)上,劃分房屋多重買賣的具體表現(xiàn)類型,評析不同情形下物權(quán)歸屬判斷標(biāo)準(zhǔn)的適用,并對房屋多重買賣中的物權(quán)歸屬問題提出了一些自己膚淺的看法。本文除“引言”和“結(jié)語”外,由以下四個(gè)部分構(gòu)成:第一章“房屋多重買賣概述”,通過厘清房屋多重買賣的內(nèi)涵及具體表現(xiàn)形式,概括了房屋多重買賣的特征,并分析了房屋多重買賣在一定的時(shí)代、社會(huì)、經(jīng)濟(jì)背景下發(fā)生的條件與原因。第二章“各種立法模式下物權(quán)歸屬之判斷標(biāo)準(zhǔn)”,通過比較不同法系的不同物權(quán)變動(dòng)模式以及不同物權(quán)變動(dòng)模式下關(guān)于物權(quán)歸屬的相關(guān)法律規(guī)定,分析了國外立法在物權(quán)變動(dòng)中確定物權(quán)歸屬的判斷標(biāo)準(zhǔn)。第三章“房屋多重買賣中物權(quán)歸屬之判斷標(biāo)準(zhǔn)”,通過整理學(xué)說理論關(guān)于多重買賣中履行順序及物權(quán)歸屬的不同觀點(diǎn),并在此基礎(chǔ)上結(jié)合我國司法實(shí)務(wù)中的相關(guān)規(guī)定和指導(dǎo)意見,分析了我國目前關(guān)于房屋多重買賣中物權(quán)歸屬之判斷標(biāo)準(zhǔn)的立法概況。第四章“房屋多重買賣中物權(quán)歸屬之我見”,通過分析房屋多重買賣中的合同效力,在劃分房屋多重買賣類型的基礎(chǔ)上,就房屋多重買賣中各種具體情形下物權(quán)歸屬的判斷標(biāo)準(zhǔn)進(jìn)行選擇,確定了具體情形下的履行順序及物權(quán)歸屬,并對擬定中的相關(guān)司法解釋提出了一些自己的意見。
[Abstract]:Under the influence of the rapid development of the market economy, the phenomenon of multiple purchase and sale of houses is increasing day by day. In the course of trading, the sellers are based on the high value of the houses. The characteristics of market scarcity and rigid demand sell the same house to multiple buyers in order to maximize economic benefits. However, the current legislation and judicial interpretation of the above phenomenon of multiple transactions in the actual order of performance and ownership of property has not been clearly defined. Although the Supreme people's Court has formulated relevant provisions to guide the correct application of the law to deal with the rights disputes arising from the multiple purchase and sale of houses, there is still room for discussion on the reasonableness of this provision. In view of this, this paper analyzes the characteristics of multi-transaction of house, compares the judgment standard of property ownership under different real right change mode, and investigates the judicial practice and theory about the judgment standard of property ownership of house multi-transaction in our country. This paper classifies the concrete expression types of the multiple sale of houses, analyzes on the application of the judgment standard of the ownership of real right under different circumstances, and puts forward some superficial views on the ownership of the real right in the multifold purchase and sale of houses. In addition to "introduction" and "conclusion", this paper is composed of the following four parts: chapter one, "A summary of the multiple transactions of houses", summarizes the characteristics of the multiple transactions of houses by clarifying the connotation and specific forms of expression of the multiple transactions of houses. The paper also analyzes the conditions and causes of the multi-sale of houses in certain times, society and economy. The second chapter, "judging standard of ownership of real right under various legislative models", compares the different modes of real right change in different legal systems and the relevant legal provisions about property right ownership under different modes of real right change. This paper analyzes the criterion of determining the ownership of real right in foreign legislation. The third chapter, "the judgment standard of property ownership in the multiple purchase and sale of houses", through sorting out the different viewpoints on the order of performance and the ownership of real right in the multiple transaction theory, On this basis, combined with the relevant provisions and guidance in the judicial practice of our country, this paper analyzes the legislative survey of the judgment standard of the property right in the multi-purchase and sale of houses in our country at present. Chapter four, "my opinion on the ownership of Real right in the Multi-sale of Housing", through the analysis of the effectiveness of the contract in the multi-transaction of the house, on the basis of dividing the type of the multi-transaction of the house, This paper makes a choice on the judgment standard of the ownership of real right under various specific circumstances in the multiple transactions of houses, determines the order of performance and the ownership of the real right under the specific circumstances, and puts forward some opinions on the relevant judicial interpretation in the future.
