【摘要】：監(jiān)護權撤銷制度的設立初衷在于以公權力介入來補私權自治的不足,以確保監(jiān)護權的正確行使,維護未成年人的合法權益。制度設計本身內含著人倫向度上的回應�；谖覈H權與監(jiān)護權混同的立法現(xiàn)狀,本文的監(jiān)護權撤銷是對原始親權有限度的剝離,即只有在窮盡其他救濟手段無果時才能啟動。監(jiān)護權彰顯的親情家庭屬性,使得我們的制度考量應該體現(xiàn)周全和圓整。為此應更多地關注監(jiān)護權撤銷前的干預監(jiān)督及事后的判后安置,力求在合乎制度訴求價值底線前提下促成被撤銷監(jiān)護權的再度回歸。
[Abstract]:The original intention of the revocation of custody system is to make up for the deficiency of private right autonomy by public power intervention to ensure the correct exercise of guardianship and to safeguard the lawful rights and interests of minors. The system design itself contains the response of the human relationship dimension. Based on the legislative situation of parental power and guardianship in our country, the revocation of guardianship in this paper is a limited stripping of the original parental right, that is, it can only be started when other remedies are exhausted. Custody of the family, so that our institutional considerations should reflect integrity and integrity. Therefore, more attention should be paid to the intervention supervision before the revocation of custody and the post-sentence placement, in order to promote the return of the revoked custody under the premise of meeting the bottom line of the system's claim value.
