【摘要】：從法律解釋學(xué)、著作權(quán)國際條約以及現(xiàn)有的國內(nèi)司法實(shí)踐三個(gè)角度分析,不宜通過修改《著作權(quán)法》第36條將版式設(shè)計(jì)權(quán)擴(kuò)張到網(wǎng)絡(luò)傳播中。在此基礎(chǔ)上,筆者建議,趁《著作權(quán)法》第三次修改之際,可以考慮廢除《著作權(quán)法》第36條,進(jìn)而把版式設(shè)計(jì)權(quán)納入《著作權(quán)法》和《反不正當(dāng)競爭法》保護(hù)范疇,而不必單設(shè)鄰接權(quán)予以保護(hù)。
[Abstract]:From the perspective of legal hermeneutics, international copyright treaties and the existing domestic judicial practice, it is not appropriate to extend the right of typographic design to the network dissemination by amending Article 36 of the copyright Law. On this basis, the author suggests that, on the occasion of the third revision of the copyright Law, consideration should be given to repealing Article 36 of the copyright Law so as to bring the right of typographic design into the protection category of the copyright Law and the Anti-unfair Competition Law. It does not need to be protected only by neighboring rights.
