【摘要】：數(shù)字技術(shù)的發(fā)展改變了傳統(tǒng)出版業(yè)中版權(quán)傳播、交易和保護(hù)的模式,技術(shù)措施從技術(shù)層面上為著作權(quán)人提供了保護(hù)機(jī)制。然而,技術(shù)措施能夠被使用人規(guī)避,反規(guī)避技術(shù)措施的規(guī)則便應(yīng)運(yùn)而生,反規(guī)避規(guī)則雖有其合理性,但卻存在諸多缺陷,不利于消費(fèi)者正常地獲取和使用作品,不能真正緩解數(shù)字出版業(yè)與消費(fèi)者之間的沖突。因此,應(yīng)當(dāng)將技術(shù)措施、權(quán)利管理信息與合同條款結(jié)合起來(lái),合理運(yùn)用技術(shù)措施與權(quán)利管理信息,平衡數(shù)字出版視域下著作權(quán)人、數(shù)字出版商和消費(fèi)者三者間的權(quán)益。
[Abstract]:The development of digital technology has changed the mode of copyright transmission, transaction and protection in the traditional publishing industry. Technical measures provide a protection mechanism for the copyright owner from the technical level. However, the technical measures can be avoided by the use of the use of people, and the rules of anti circumvention of technical measures emerge as the times require. Although the anti circumvention rules have its rationality, there are many shortcomings. It is not conducive to the normal acquisition and use of works by consumers, which can not truly alleviate the conflict between the digital publishing industry and the consumer. Therefore, it should be combined with the technical measures, the rights management information and the contract terms, the rational use of technical measures and rights management information, and the balance of the copyright owners, digital publishers and consumption in the digital publishing field. The rights and interests between the three.
