【摘要】：隱私權(quán)從傳統(tǒng)的消極防御功能發(fā)展出兼有積極支配功能的雙重屬性,內(nèi)容包括隱私隱瞞權(quán)、隱私利用權(quán)、隱私維護權(quán)和隱私支配權(quán)�；颊唠[私權(quán)的四項權(quán)能對應《侵權(quán)責任法》第六十二條、第六十一條、第五十五條和第五十六條,構(gòu)建出完整的患者隱私權(quán)保護規(guī)范體系�；颊唠[私權(quán)被侵犯的實質(zhì)表現(xiàn)形式是醫(yī)院侵犯其知情同意權(quán),患者隱私可以分為兩部分,醫(yī)療機構(gòu)對正常范圍的隱私知悉不構(gòu)成侵權(quán);超出正常的隱私讓渡范圍時,醫(yī)療機構(gòu)必須取得患者的知情同意�；颊唠[私權(quán)與第三人利益、公共利益發(fā)生沖突時,應作出相應的讓位。
[Abstract]:The right to privacy develops from the traditional passive defense function and has the dual attributes of positive dominating function, including the right to conceal privacy, the right to use privacy, the right to maintain privacy and the right to control privacy. The four powers of patient privacy correspond to Article 62, Article 61, Article 55 and Article 56 of the Tort liability Law. The essential manifestation of the infringement of the patient's privacy is that the hospital infringes on its right of informed consent. The patient's privacy can be divided into two parts. The medical institution's knowledge of the normal range of privacy does not constitute an infringement; when it exceeds the normal scope of privacy transfer, Medical institutions must obtain the patient's informed consent. When the patient's right to privacy conflicts with the interests of the third party and the public interest, the patient should give way accordingly.
