【摘要】：法律保護地理標志已有百年的歷史,但其真正引起各國的重視是從TRIPs協(xié)議中為其設(shè)定專門一節(jié)加以規(guī)定開始。當(dāng)前國際上主要存在以歐盟為代表的專門法保護模式,以美國為典型的商標法保護模式,以及德國的混合保護模式,三種地理標志保護的模式各具有特色,各國根據(jù)本國的法律傳統(tǒng)和實際對地理標志加以保護。我國憑借廣袤的土地、復(fù)雜的地形、多樣的氣候變化和深厚的歷史文化底蘊而成為地理標志資源大國,但地理標志保護法律制度遠不及西方發(fā)達國家。不僅民眾對地理標志保護的意識淡薄,國家當(dāng)前對地理標志的保護制度也混亂不清,尤其在各地方,地理標志的保護工作標準各不相同,不利于我國地理標志保護工作的開展。為此,本文開篇從梳理地理標志的相關(guān)概念入手,理清地理標志保護的發(fā)展淵源,再通過對我國現(xiàn)有的地理標志保護制度進行比較研究,總結(jié)我國當(dāng)前地理標志保護制度的現(xiàn)狀。同時結(jié)合筆者通過查詢政府相關(guān)部門官方網(wǎng)站,采取走訪調(diào)研、采訪、電話咨詢等多種手段相結(jié)合的方式,獲取有關(guān)主管部門及企業(yè)、協(xié)會等地理標志相關(guān)信息,梳理我國當(dāng)前對地理標志保護的制度,理清不同制度的異同及優(yōu)缺,分析我國在地理標志法律保護制度方面存在的問題,為我國地理標志法律保護制度的構(gòu)建提出合理的建議。
[Abstract]:Legal protection of geographical indications has a history of one hundred years, but its real attention is from the TRIPs agreement set up a special section to be stipulated. At present, there are mainly special legal protection models represented by the European Union, trademark law protection models typical of the United States and mixed protection models of Germany, each of which has its own characteristics. Countries protect geographical indications in accordance with their legal traditions and practices. China has become a great country of geographical indication resources because of its vast land, complex terrain, diverse climate change and profound historical and cultural background, but the legal system of geographical indication protection is far less than that of western developed countries. Not only the consciousness of the people on the protection of geographical indications is weak, but also the current national protection system of geographical indications is confused, especially in different places, the standards of the protection of geographical indications are different, which is not conducive to the development of the protection of geographical indications in our country. Therefore, this paper begins with combing the related concepts of geographical indication, clarifies the origin of the development of geographical indication protection, and then makes a comparative study on the existing system of geographical indication protection in China. This paper summarizes the current situation of geographical indication protection system in China. At the same time, by consulting the official websites of the relevant government departments, and adopting a combination of visiting, investigating, interviewing, telephone consulting and other means, the author can obtain relevant information related to geographical indications, such as relevant departments, enterprises, associations, etc. This paper combs the current system of geographical indication protection in our country, clarifies the similarities and differences of different systems, analyzes the problems existing in the legal protection system of geographical indications in our country, and puts forward some reasonable suggestions for the construction of the legal protection system of geographical indications in our country.
