“e代駕”服務(wù)中的民事法律問題探究

【摘要】:“e代駕”是一款用于尋找代駕的便捷手機(jī)應(yīng)用!癳代駕”軟件運(yùn)營公司將需要代駕的客戶信息提供給代駕司機(jī),其接單后依照被代駕人的要求到達(dá)指定位置并駕駛被代駕人的車輛將被代駕人及車輛安全送至目的地,后獲得報(bào)酬并按要求支付軟運(yùn)營公司20%的信息費(fèi)用。新型網(wǎng)絡(luò)代駕給人們生活帶來了便利的同時(shí)我們也應(yīng)看見其在法律上面臨的困境:因立法空白,現(xiàn)實(shí)中此類案件的司法判決不盡相同!癳代駕”服務(wù)中代駕司機(jī)、軟件運(yùn)營公司和被代駕人三者之間的法律關(guān)系及責(zé)任認(rèn)定則成為判決的重要依據(jù)。本文從三個(gè)方面論述“e代駕”服務(wù)涉及的法律問題:在充分理解兩個(gè)典型案件的基礎(chǔ)之上,簡要介紹由“e代駕”服務(wù)所引發(fā)的關(guān)于勞動(dòng)爭議和交通事故責(zé)任糾紛的案件,并通過分析案件事實(shí)及判決依據(jù)得出爭議焦點(diǎn),即“e代駕”服務(wù)中軟件運(yùn)營公司與代駕司機(jī)、被代駕人之間法律關(guān)系的性質(zhì)分別是什么;發(fā)生交通事故時(shí)責(zé)任如何承擔(dān)。在論述代駕司機(jī)與軟件運(yùn)營公司之間的關(guān)系上,首先對其他學(xué)者提出的勞動(dòng)關(guān)系說、雇傭關(guān)系說進(jìn)行分析探討,在論述兩種關(guān)系基本內(nèi)涵、認(rèn)定標(biāo)準(zhǔn)的基礎(chǔ)之上,提出其與“e代駕”服務(wù)中雙方關(guān)系不符,雙方實(shí)質(zhì)是一種不規(guī)則雇傭關(guān)系的觀點(diǎn)。進(jìn)一步論述何謂不規(guī)則雇傭關(guān)系,此類關(guān)系如何認(rèn)定以及如何適用法律的問題。在論述軟件運(yùn)營公司與被代駕人的法律關(guān)系性質(zhì)上,對其他學(xué)者提出的委托關(guān)系說、居間關(guān)系說予以分析探討,他們都與“e代駕”服務(wù)中雙方關(guān)系不符,雙方實(shí)質(zhì)是一種承攬關(guān)系的觀點(diǎn)及原因。在以各方之間法律關(guān)系性質(zhì)明確和現(xiàn)有法律的基礎(chǔ)之上,分析在發(fā)生交通責(zé)任事故時(shí),不同受害主體的責(zé)任承擔(dān):代駕司機(jī)受到損害時(shí),軟件運(yùn)營公司應(yīng)承擔(dān)的雇員受害責(zé)任。被代駕人受到損害時(shí),軟件運(yùn)營公司應(yīng)承擔(dān)的雇主替代責(zé)任、違約責(zé)任以及第三人的侵權(quán)責(zé)任。第三人受到損害時(shí),軟件運(yùn)營公司承擔(dān)責(zé)任的法律適用問題以及為何不需要被代駕人承擔(dān)責(zé)任的主要依據(jù)。綜合以上討論,明確“e代駕”所涉及的一系列法律問題,為此類問題的解決提供理論參考。
[Abstract]:E generation driving is a convenient mobile phone application for finding a proxy driver. The "e behalf driving" software operator provides customer information to the driver who needs to drive on behalf. After receiving the order, the vehicle will be delivered to the destination safely by the acting driver and the vehicle will be sent to the destination according to the requirements of the acting driver, and will be paid 20% of the information fee of the soft operating company as required. At the same time, we should also see the legal dilemma it faces: because of the blank legislation, the judicial decision of this kind of case is different in reality. The legal relationship and responsibility between the software operating company and the acting driver become the important basis of the judgment. This paper discusses the legal problems involved in "e-generation driving" service from three aspects: on the basis of fully understanding two typical cases, this paper briefly introduces the cases of labor disputes and traffic accident liability disputes caused by "e-generation driving" service. Through the analysis of the facts of the case and the basis of the judgment, the dispute focus is drawn, that is, what is the nature of the legal relationship between the software operating company and the acting driver in the "e-acting driving" service, and how to bear the responsibility in the event of traffic accident. On the basis of discussing the relationship between the driver and the software operating company, this paper analyzes and discusses the labor relation theory and employment relation theory put forward by other scholars, on the basis of discussing the basic connotation of the two kinds of relationship and determining the standard. It points out that the relationship between the two parties is not in accordance with the "e generation driving" service, and that the two parties are in essence an irregular employment relationship. Further discusses what is irregular employment relationship, how to determine such relationship and how to apply the law. On the basis of discussing the nature of the legal relationship between the software operating company and the acting driver, this paper analyzes and discusses the principal-relationship theory and the intermediate-relationship theory put forward by other scholars, and they all do not agree with the relationship between the two parties in the "e-acting driving" service. The essence of both parties is the viewpoint and reason of a contract relationship. On the basis of the clear nature of the legal relationship between the parties and the existing laws, this paper analyzes the liability of different injured subjects in the event of a traffic accident: the employee victimization liability of the software operation company when the driver is injured. In case of damage to the acting driver, the software operating company shall bear the employer's substitution liability, the liability for breach of contract and the tort liability of the third party. When the third party is injured, the application of the law to the liability of the software operating company and the main basis of why the liability is not required for the driver. By synthesizing the above discussion, this paper clarifies a series of legal problems involved in e-behalf driving, and provides a theoretical reference for the solution of such problems.
