【摘要】：處在數(shù)字化時(shí)代,圖書館為了滿足讀者對(duì)數(shù)字閱讀的需求,需要將其館藏作品進(jìn)行數(shù)字化復(fù)制。根據(jù)歐盟法、美國(guó)法以及已有判例,在特定情形中,圖書館從事數(shù)字化復(fù)制具有合理使用的屬性。我國(guó)現(xiàn)行的著作權(quán)法尚不能為圖書館數(shù)字化提供完善的法律基礎(chǔ)。建議準(zhǔn)許圖書館數(shù)字化其館藏作品,以適當(dāng)方式向讀者提供,并從主體、目的、數(shù)量和空間等方面施以限制。
[Abstract]:In the digital age, in order to meet the needs of readers for digital reading, libraries need to copy their collections digitally. According to European Union law, American law and existing jurisprudence, in certain cases, libraries engaged in digital reproduction have the property of reasonable use. The current copyright law in China can not provide a perfect legal basis for library digitization. It is suggested that libraries should be allowed to digitize their collections, offer them to readers in an appropriate manner, and restrict their subject, purpose, quantity and space.
