【摘要】:近幾年來(lái),北上廣地區(qū)的房地產(chǎn)價(jià)格讓人望而卻步,買(mǎi)房對(duì)工薪階層來(lái)說(shuō),成為一件困難的事。同時(shí),房屋租賃則顯得非常紅火,因此租賃合同也產(chǎn)生了大量的法律糾紛和經(jīng)濟(jì)糾紛。在租賃合同糾紛中很多是有關(guān)出租人附隨義務(wù)的糾紛,而出租人的附隨義務(wù)在實(shí)踐中的表現(xiàn)形式是多樣的,在租賃合同中有關(guān)附隨義務(wù)的糾紛主要是因?yàn)楹贤p方當(dāng)事人缺少誠(chéng)信意識(shí)造成的。附隨義務(wù)存在于合同關(guān)系發(fā)展的各個(gè)階段,要求當(dāng)事人依照誠(chéng)信原則負(fù)擔(dān)義務(wù),以維護(hù)交易秩序,保障交易安全。本文的題目是"房屋租賃合同中出租人的附隨義務(wù)",討論在房屋租賃合同中,出租人附隨義務(wù)類(lèi)型以及法律規(guī)制問(wèn)題研究,文中通過(guò)對(duì)因出租人附隨義務(wù)產(chǎn)生糾紛的案例的分析,對(duì)出租人附隨義務(wù)進(jìn)行概念上的界定,對(duì)出租人附隨義務(wù)理論形成一個(gè)體系化的認(rèn)識(shí)。通過(guò)對(duì)租賃合同的出租人的附隨義務(wù)進(jìn)行具體研究,實(shí)現(xiàn)對(duì)出租人附隨義務(wù)理論的細(xì)化和具體化,便于司法部門(mén)在解決實(shí)際問(wèn)題時(shí)能夠有法可依,出租人附隨義務(wù)理論的完善有利于有效指導(dǎo)司法實(shí)踐中的出租人附隨義務(wù)糾紛問(wèn)題。本文主要包括四個(gè)部分:第一部分是出租人的附隨義務(wù)及特點(diǎn),主要內(nèi)容是描述了附隨義務(wù)的概念,以及對(duì)出租人的附隨義務(wù)的界定和出租人附隨義務(wù)的特征。第二部分是出租人附隨義務(wù)與近似義務(wù)之比較,重點(diǎn)說(shuō)明了出租人的附隨義務(wù)與出租人的給付義務(wù)、不真正義務(wù)是完全不同的義務(wù),通過(guò)對(duì)出租人附隨義務(wù)相關(guān)概念的辨析,厘清出租人附隨義務(wù)與其他義務(wù)的界限。第三部分是出租人附隨義務(wù)的類(lèi)型化分析,這一部分的內(nèi)容是闡述出租人的附隨義務(wù)中具體包括哪些義務(wù),通過(guò)對(duì)出租人附隨義務(wù)中具體義務(wù)的探討,領(lǐng)會(huì)在實(shí)踐中出租人附隨義務(wù)的具體適用。第四部分是出租人附隨義務(wù)的法律規(guī)制,描述了我國(guó)當(dāng)前租賃合同中出租人附隨義務(wù)的法律現(xiàn)狀,討論出租人附隨義務(wù)的法律后果,包括民事責(zé)任形式和歸責(zé)原則等,同時(shí)對(duì)出租人附隨義務(wù)的理論完善提出具體的建議。
[Abstract]:In recent years, real estate prices have been prohibitive in the north of Guangzhou, making it difficult for the working class to buy a home. At the same time, the housing lease is very popular, so the lease contract has also produced a large number of legal disputes and economic disputes. In the dispute of lease contract, many disputes are related to the lessor's collateral obligation, and the lessor's collateral obligation has various forms in practice. The dispute about collateral obligation in the lease contract is mainly caused by the lack of good faith consciousness between the parties to the contract. The collateral obligation exists in all stages of the development of the contract relationship, which requires the parties to bear the obligation according to the principle of good faith in order to maintain the order of the transaction and to ensure the security of the transaction. The title of this paper is "the collateral obligation of the lessor in the house lease contract". This paper discusses the types of the lessor's collateral obligation and the legal regulation in the housing lease contract. Based on the analysis of the disputes arising from the collateral obligation of the lessor, this paper defines the concept of the collateral obligation of the lessor and forms a systematic understanding of the theory of the collateral obligation of the lessor. Through the specific research on the collateral obligation of the lessor of the lease contract, the theory of collateral obligation of the lessor can be refined and concretized, so that the judicial department can have legal basis to solve the practical problems. The perfection of the theory of lessor's collateral obligation is helpful to guide the dispute of the lessor's collateral obligation in judicial practice. This paper mainly includes four parts: the first part is the collateral obligation and characteristics of the lessor, the main content is to describe the concept of collateral obligation, as well as the definition of the collateral obligation of the lessor and the characteristics of the collateral obligation of the lessor. The second part is the comparison between the collateral obligation of the lessor and the approximate obligation, which emphasizes that the collateral obligation of the lessor is different from the obligation of the lessor to pay, and that the non-real obligation is completely different, and through the discrimination of the related concepts of the collateral obligation of the lessor, Clarify the line between the lessor's collateral obligation and other obligations. The third part is the type analysis of the lessor's collateral obligation. The content of this part is to elaborate the specific obligations included in the lessor's collateral obligation, through the exploration of the specific obligations of the lessor's collateral obligation. Understand the specific application of the lessor's collateral obligation in practice. The fourth part is the legal regulation of the lessor's collateral obligation, describes the legal status of the lessor's collateral obligation in China's current lease contract, and discusses the legal consequences of the lessor's collateral obligation, including the form of civil liability and the principle of liability imputation. At the same time, the theoretical perfection of the lessor's collateral obligation is put forward.
