【摘要】：機會喪失規(guī)則是侵權(quán)法理論的修正和補充,是基于對事實發(fā)生存在不確定性的案件應(yīng)對而產(chǎn)生的一種制度設(shè)計。機會喪失規(guī)則在法國、英國、美國等國家有著豐富的理論研究成果和司法判例,我國囿于法律規(guī)定和理論研究的缺失,司法實踐中鮮有以機會喪失為由提起訴訟的案件。機會喪失規(guī)則應(yīng)用于醫(yī)療領(lǐng)域有其理論依據(jù),我國侵權(quán)法應(yīng)用機會喪失規(guī)則應(yīng)在采取機會喪失規(guī)則的有限度應(yīng)用原則、科學(xué)選擇機會利益的保護(hù)規(guī)則、按比例賠償原則、確立機會喪失規(guī)則的認(rèn)定標(biāo)準(zhǔn)、專家陪審員和專家輔助人的應(yīng)用等方面予以完善,為我國司法實踐提供有益參考。
[Abstract]:Opportunity loss rule is a revision and supplement of tort law theory, and it is a kind of system design based on the case response to the fact that there is uncertainty. In France, Britain, the United States and other countries, there are abundant theoretical research results and judicial precedents. In our country, due to the lack of legal provisions and theoretical research, there are few cases brought on the grounds of opportunity loss in judicial practice. There is a theoretical basis for the application of opportunity loss rules in the field of medical treatment. The application of opportunity loss rules in tort law of our country should be based on the principle of limited application of opportunity loss rules, the scientific choice of protection rules of opportunity interests, and the principle of proportional compensation. The establishment of the standard of the rules of loss of opportunity, the application of expert jurors and expert auxiliaries and so on, will provide a useful reference for the judicial practice of our country.
