【摘要】：本文在探討醫(yī)療過錯的概念與特點的基礎(chǔ)上,采用比較分析方法和規(guī)范分析方法,研究醫(yī)療過錯的判斷標準與具體認定規(guī)則,進一步分析現(xiàn)有醫(yī)療過錯類型化理論及其存在問題：尤其結(jié)合典型醫(yī)療糾紛案例為基礎(chǔ),沿著醫(yī)療環(huán)節(jié)進程中的具體注意義務,對醫(yī)療過錯行為進行類型化,以期對司法實踐和醫(yī)院依法管理、提高患者安全提供有益幫助。
[Abstract]:On the basis of discussing the concept and characteristics of medical fault, this paper uses comparative analysis method and normative analysis method to study the judgment standard and specific identification rules of medical fault, and further analyzes the existing medical fault type theory and its existing problems, especially on the basis of the typical medical dispute cases, along with the process of medical links. The specific duty of care is to categorization medical malpractice in order to provide useful help for judicial practice and hospital management according to law and improving patient safety.
