【摘要】:農(nóng)村宅基地使用權(quán)事關(guān)農(nóng)民安身立命的根本,事關(guān)農(nóng)村乃至國(guó)家社會(huì)的經(jīng)濟(jì)發(fā)展,是兼有公法與私法雙重價(jià)值取向的用益物權(quán)。隨著經(jīng)濟(jì)建設(shè)不斷加進(jìn),當(dāng)下的農(nóng)村宅基地使用權(quán)登記制度已無(wú)法滿足社會(huì)需要,日益凸顯的登記問(wèn)題,已成為學(xué)界研究的熱題。當(dāng)前我國(guó)高度重視宅基地使用權(quán)登記工作存在的問(wèn)題,在全國(guó)先后開(kāi)展三十二個(gè)試點(diǎn)進(jìn)行有關(guān)方面的改革,本文正是從此改革實(shí)踐出發(fā),針對(duì)改革現(xiàn)狀,提出當(dāng)前宅基地登記存在問(wèn)題,并對(duì)構(gòu)建宅基地使用權(quán)登記機(jī)制提出科學(xué)化建議。本文除引言外,共由三部分構(gòu)成,即農(nóng)村宅基地使用權(quán)確權(quán)登記現(xiàn)狀考察、當(dāng)前我國(guó)農(nóng)村宅基地使用權(quán)確權(quán)登記存在的問(wèn)題以及關(guān)于農(nóng)村宅基地使用權(quán)確權(quán)登記問(wèn)題的對(duì)策。第一部分綜合考察了我國(guó)當(dāng)前農(nóng)村宅基地使用權(quán)登記現(xiàn)狀,從宏觀上對(duì)登記工作進(jìn)行研究把握,選取了全國(guó)三十二個(gè)改革試驗(yàn)地中比較典型的案例,即山東省萊蕪市、四川成都市兩處改革試點(diǎn)工作現(xiàn)狀作為考察重點(diǎn)分析對(duì)象,對(duì)登記的具體環(huán)節(jié)的亮點(diǎn)與不足等作出了客觀的描述及分析。第二部分在上述考查基礎(chǔ)上,全面探析了實(shí)踐中農(nóng)村宅基地使用權(quán)確權(quán)登記中存在的問(wèn)題。當(dāng)下宅基地使用權(quán)確權(quán)登記實(shí)踐中,現(xiàn)有登記制度的嚴(yán)重滯后性,宅基地面積、數(shù)量嚴(yán)重超標(biāo),宅基地檔案混亂,資料不清權(quán)屬不明,登記人員匱乏,經(jīng)費(fèi)不足等問(wèn)題突出,且我國(guó)關(guān)于宅基地登記的相關(guān)制度不健全,對(duì)戶籍、登記主體等缺乏統(tǒng)一的規(guī)范,這些問(wèn)題是我國(guó)當(dāng)前宅基地使用權(quán)確權(quán)登記工作的困境。第三部分提出了針對(duì)當(dāng)前宅基地登記存在的系列問(wèn)題的對(duì)策,包括探索宅基地有償退出機(jī)制,完善登記賠償機(jī)制以及合理配置人力資源,加大資金投入等。綜上所述,本文立足我國(guó)宅基地使用權(quán)登記現(xiàn)狀,對(duì)當(dāng)前宅基地使用權(quán)登記存在問(wèn)題歸納分析,并對(duì)我國(guó)農(nóng)村宅基地使用權(quán)登記制度建立提出了科學(xué)化建議。
[Abstract]:The right to use the rural homestead is related to the root of the peasants' standing, the economic development of the rural and the state society, and the usufructuary right with both public and private values. With the continuous improvement of the economic construction, the current registration system for the right to use the rural homestead has not met the needs of the society, and the problem of registration has become increasingly prominent. At present, China attaches great importance to the problems existing in the registration of the right to use homestead, and has carried out thirty-two pilot projects in the country to carry out the reform of the relevant aspects. This article is starting from the practice of reform, aiming at the present situation of the reform, and putting forward the existing problems of the current homestead registration and the registration of the right to use the homestead. In addition to the introduction, this paper consists of three parts, namely, the current status of the right registration of rural homestead right of use, the existing problems of the right right registration of rural homestead in our country and the Countermeasures of the right registration of rural homestead right of use in the countryside. The first part comprehensively inspects the current rural homestead in China The status of the registration of the right to use the land, from the macro to the study of the registration work, select the thirty-two typical cases in the thirty-two test areas of the national reform, namely, Laiwu, Laiwu, Sichuan and Chengdu, Sichuan Chengdu city reform pilot work status as the focus of analysis, the specific links of the registration of the highlights and deficiencies made objective On the basis of the above examination, the second part analyses the problems in the registration of the right to use the rural homestead in practice. At present, the current registration system is seriously lagged, the area of the homestead, the quantity of the homestead is seriously exceeding the standard, the residence land file is chaotic, and the information is unclear. The lack of registration personnel, insufficient funds and other problems are outstanding, and the related system of house land registration is not perfect in our country, and there is no unified standard on the household registration and registration subjects. These problems are the plight of the current registration of the right to use homestead in our country. The third part puts forward the series of problems on the current housing land registration. The policy, including exploring the payment mechanism of the homestead, perfecting the registration compensation mechanism and the rational allocation of human resources, and increasing the capital investment. In summary, this paper, based on the status of the registration of the right to use the homestead in China, summarizes the problems of the current registration of the right to use the homestead, and establishes the registration system for the right to use the rural homestead in our country. A scientific proposal has been made.
