【摘要】：我國(guó)立法并未承認(rèn)代理授權(quán)行為無(wú)因性原則,司法實(shí)踐中亦無(wú)以該無(wú)因性原則為依據(jù)作出的判決,部分學(xué)者主張通過(guò)表見代理制度實(shí)現(xiàn)授權(quán)行為無(wú)因性原則維護(hù)交易安全的制度功能。事實(shí)上,無(wú)論從制度基礎(chǔ)與適用前提層面,還是從對(duì)交易安全的保護(hù)力度層面考察,授權(quán)行為無(wú)因性原則具有表見代理無(wú)法取代的制度優(yōu)勢(shì)。對(duì)于學(xué)者指出的該無(wú)因性原則會(huì)保護(hù)惡意相對(duì)人的弊端,可以通過(guò)禁止代理權(quán)濫用制度予以克服,相對(duì)人明知代理權(quán)濫用或因代理權(quán)濫用顯而易見而不可能不知道代理權(quán)濫用的,不得向被代理人主張代理行為的效力。我國(guó)未來(lái)的《民法典》應(yīng)當(dāng)采納授權(quán)行為無(wú)因性原則和禁止代理權(quán)濫用制度以全面保護(hù)交易安全及被代理人的利益。
[Abstract]:The legislation of our country does not recognize the principle of the uncausality of the act of agency authorization, and there is no judgment made on the basis of the principle of non-causality in judicial practice. Some scholars advocate the realization of the system function of transaction security by the principle of "apparent agency". In fact, whether from the system foundation and the applicable premise level, or from the level of the protection of transaction security, the principle of non-causality of authorized behavior has the institutional advantages that can not be replaced by apparent agency. This principle, which scholars have pointed out, will protect the malevolent counterpart, and can be overcome by prohibiting the abuse of the agency. If the relative party knows that the abuse of agency power is obvious or that it is impossible not to know the abuse of agency right, he shall not claim the validity of agency act to the principal. The future Civil Code of our country should adopt the principle of uncausality of authorized behavior and the prohibition of agency abuse system in order to protect the security of transactions and the interests of the principal in an all-round way.
