【摘要】：征地留用地安置作為我國地方征地實(shí)踐中探索的多元化補(bǔ)償方式,是自下而上的制度創(chuàng)新,有利于被征地農(nóng)民分享到城市發(fā)展的土地增值收益,一定程度上解決了被征地農(nóng)民長遠(yuǎn)生計(jì)。但是留用地安置制度由于缺乏法律層面支持,在各地實(shí)踐中也存在不少問題,亟待研究和解決。征地留用地使用權(quán)的物權(quán)化,不僅有利于被征地農(nóng)民更好地實(shí)現(xiàn)土地財(cái)產(chǎn)權(quán),確保被征地農(nóng)民長遠(yuǎn)生計(jì),而且對(duì)我國土地權(quán)利法制建設(shè)大有裨益。
[Abstract]:As a diversified compensation method explored in the practice of local land expropriation, land expropriation and reserved land resettlement is a bottom-up system innovation, which is conducive to the peasants who have been expropriated to share the land value-added benefits of urban development. To a certain extent, to solve the land requisition farmers long-term livelihood. However, due to the lack of legal support, there are many problems in the practice of the retention resettlement system, which need to be studied and solved urgently. The property right of land requisition and use right is not only beneficial to the peasants who have been expropriated to realize the land property right, but also beneficial to the legal construction of land rights in our country.
