【摘要】:從2006年胡戈創(chuàng)作的《一個饅頭引發(fā)的血案》到如今的《西游降魔篇》、《舌尖上的宿舍》等,這些戲仿作品的出現(xiàn)不僅成為了國民關(guān)注的焦點,也引起了學術(shù)各界相關(guān)人士的廣泛關(guān)注。戲仿作品是指在文學藝術(shù)領(lǐng)域內(nèi)通過模仿、借用被戲仿作品的內(nèi)容,以達到對被戲仿作品進行諷刺、調(diào)侃、娛樂或評論的目的,體現(xiàn)戲仿者獨創(chuàng)性的作品。它包括文學作品、影視作品、音像制品等,形式多樣,創(chuàng)作和表達的方式也呈多樣化。戲仿作品的評論性和戲謔性雖然給我國現(xiàn)行的著作權(quán)法帶來了挑戰(zhàn),但戲仿作品的著作權(quán)法保護有其理論基礎(chǔ),對戲仿作品的保護既是對民眾表達言論和觀點之權(quán)利的保護,也體現(xiàn)了著作權(quán)法維護著作權(quán)人利益和戲仿者利益之平衡的原則�?墒俏覈鳈�(quán)法并未界定戲仿作品的內(nèi)涵,沒有明確戲仿作品的著作權(quán)歸屬,對合理使用的規(guī)定也尚未完善。而西方國家對戲仿作品之法律問題的研究比較深入,已經(jīng)做出了較為完善的處理規(guī)范。本文試圖在現(xiàn)行的著作權(quán)法框架下,結(jié)合國外的相關(guān)法律經(jīng)驗,對戲仿作品的著作權(quán)法保護提出一些法律建議。 本文主要包括五個部分。第一部分對戲仿作品進行概述。通過闡述戲仿作品的由來、概念、條件以及和相關(guān)概念之比較,對戲仿作品加以界定。隨后根據(jù)戲仿作品的分類,闡明本文主要研究的戲仿作品類型。之后分析戲仿作品的法律特征,為戲仿作品的著作權(quán)法保護做鋪墊;第二部分闡述了戲仿作品著作權(quán)法保護的理論基礎(chǔ)。分析戲仿作品受到著作權(quán)法保護與言論自由、文藝創(chuàng)作自由、鼓勵作品創(chuàng)作與傳播、利益平衡之間的一致性,表明了戲仿作品得到著作權(quán)法保護的合法性;第三部分評析國外著作權(quán)法對戲仿作品的保護模式,從中得出完善我國戲仿作品著作權(quán)法保護的啟示;第四部分分析我國著作權(quán)法對戲仿作品的保護存在的問題。即未明確規(guī)定戲仿作品及其著作權(quán)歸屬,難以援引現(xiàn)行的合理使用制度。第五部分根據(jù)以上分析提出完善我國戲仿作品著作權(quán)法保護的建議:確立戲仿作品著作權(quán)法保護應(yīng)遵循的原則,將戲仿作品列為著作權(quán)法的保護對象,明確戲仿作品的著作權(quán)歸屬,明確界定戲仿作品構(gòu)成合理使用的條件。
[Abstract]:The appearance of "a steamed bun caused by a steamed bun" by Hu Ge in 2006, to the present "the West tour demons >", "the dorm on the tip of the tongue", has not only become the focus of the national attention, but also caused extensive attention of the relevant people from all walks of life. The parody refers to the imitation of the play in the field of art and art. In order to achieve the purpose of satirize, ridicule, entertain, or comment on the parody, it embodies the original work of the parody. It includes literary works, film and television, audio-visual products and so on. It is diversified in form, and in the way of creation and expression. The commentary and banter of parody works give the current copyright law of China There is a challenge, but the copyright law protection of the parody has its theoretical basis. The protection of the parody works is not only the protection of the rights of the people to express their opinions and opinions, but also the principle that the copyright law protects the interests of the copyright owners and the interests of the parody. However, the copyright law of our country does not define the connotations of the parody works. The ascription of copyrights of imimic works and the provision of reasonable use have not been perfected. While the western countries have made a more thorough study of the legal issues of parody works and have made a more perfect processing standard. This article tries to protect the copyrights law of parody works under the current copyright law framework and the legal experience of foreign countries. Give some legal advice.
This article mainly includes five parts. The first part is an overview of parody works. Through the explanation of the origin, concept, conditions and related concepts of parody, the parody works are defined. Then, according to the classification of the parody works, the types of imitation of the play are clarified. Then the legal characteristics of the parody works are analyzed. To pave the way for the copyright law protection of the parody works, the second part expounds the theoretical basis for the protection of the copyright law of the parody works, analyzes the freedom of copyright law protection and speech, the freedom of literary creation, the creation and dissemination of the works, and the consistency of the balance of interests, which shows that the parody works are protected by the copyright law. The third part reviews the protection mode of the foreign copyright law to the parody works, and draws the inspiration to improve the protection of the copyright law of the parody in our country; the fourth part analyses the problems in the protection of the parody works in our country's copyright law. The fifth part, according to the above analysis, proposes to improve the protection of the copyright law of Chinese parody works: to establish the principles to be followed in the protection of the copyright law of the parody works, to list the parody works as the protection object of the copyright law, to clarify the ownership of the copyrights of the parody works, and to define the conditions for the rational use of the parody works.
