【摘要】:我國物權(quán)法已于2007年10月1號開始實行。該法第九條規(guī)定:“不動產(chǎn)物權(quán)的設(shè)立、變更、轉(zhuǎn)讓和消滅,經(jīng)依法登記,發(fā)生效力;未經(jīng)登記,不發(fā)生效力,但法律另有規(guī)定的除外!彼,在我國,不動產(chǎn)物權(quán)具有法律效應(yīng)的評判標(biāo)準(zhǔn)即是否經(jīng)過登記。不動產(chǎn)物權(quán)登記制度是我國物權(quán)法的重要制度,是公信原則的法律基礎(chǔ)。不動產(chǎn)物權(quán)登記包括初始登記、變更登記、注銷登記,同時對不動產(chǎn)權(quán)利進行限制的登記,包括法院查封、抵押登記等,筆者認為也都屬于不動產(chǎn)物權(quán)登記的范疇。因此,在不動產(chǎn)物權(quán)登記過程中,審查登記申請人是否為真實權(quán)利人,協(xié)助司法部門進行查封、解封、強制過戶,根據(jù)當(dāng)事人申請進行抵押登記,等等,是登記部門的日常工作中廣泛遇到的情況?墒羌词构ぷ鲬B(tài)度嚴謹、制度過硬,在工作中也常常會遇到許多出乎意料的問題,可能會導(dǎo)致登記過程出現(xiàn)紕漏,給與之相關(guān)的人員帶來損失。英國法彥說“沒有救濟就沒有權(quán)利”。根據(jù)我國物權(quán)法第二十一條規(guī)定的內(nèi)容,當(dāng)事人若在登記過程中弄虛作假,損害他人利益的,應(yīng)該做出相應(yīng)的賠償;由于登記錯誤造成的損失,其中包括對當(dāng)事人和他人,那么登記部門應(yīng)該做出相應(yīng)的賠償。登記部門承擔(dān)責(zé)任之后,再自行歸咎責(zé)任至造成登記錯誤的個人,然后索取賠償。由法律規(guī)定可知,不動產(chǎn)物權(quán)登記出現(xiàn)問題時如何進行矯正和賠償,是必須要思考和解決的問題。筆者是一名法律實務(wù)工作者,在司法實踐中,有一些案例與不動產(chǎn)物權(quán)登記息息相關(guān),比如農(nóng)村宅基地使用權(quán)人和宅基地上建筑物所有人不一致、甲的房屋錯誤登記在乙的名下引發(fā)的糾紛;比如法院查封期限已到登記機關(guān)卻不解封一定要求法院出具解封通知、在辦理抵押登記時登記機關(guān)一定要求當(dāng)事人確定抵押時間等做法是否具有法律依據(jù)。諸如此類問題,處理不妥,便引發(fā)行政訴訟、司法確權(quán),同時也凸顯法律規(guī)定的空白。因此,筆者在本文中,擬從實踐出發(fā),試著探討一些不動產(chǎn)物權(quán)登記過程中發(fā)生的錯誤,并對錯誤發(fā)生后如何進行救濟,以及沒有法律規(guī)定的情況下如何處理?試著提出一些自己的建議和看法。
[Abstract]:China's real right law has been implemented on October 1, 2007. Article 9 of the Law states: "the establishment, alteration, transfer and elimination of real property rights shall be registered according to law and shall not have effect unless otherwise provided by law." Therefore, in our country, the real estate right has the legal effect judgment standard, namely whether through the registration. The registration system of real estate right is an important system of real right law of our country and the legal basis of the principle of public trust. Real property registration includes initial registration, change registration, cancellation registration, at the same time the registration of restrictions on real estate rights, including court seizure, mortgage registration, and so on, which are also considered to belong to the category of real property registration. Therefore, in the process of real estate property registration, we should examine whether the registration applicant is a true right holder, assist the judicial authorities in sealing up, unsealing, compulsory transfer of ownership, mortgage registration according to the application of the parties, and so on. It is a situation widely encountered in the daily work of the registration department. But even if the work attitude is strict and the system is perfect, there are often many unexpected problems in the work, which may lead to the mistakes in the registration process and the loss to the relevant personnel. Britain's Francois said "there is no right without relief". According to the provisions of Article 21 of the property Law of our country, if the parties engage in fraud in the registration process and damage the interests of others, they should make corresponding compensation; the losses caused by the registration errors include those to the parties and others, So the registration department should make the corresponding compensation. After the registration office has assumed responsibility, blame itself to the person who caused the registration error, and then claim compensation. According to the law, it is necessary to think about and solve the problem of how to correct and compensate for the problems in real estate registration. The author is a legal practice worker, in the judicial practice, there are some cases and real estate registration is closely related, such as rural homestead use right and home-based building owners are not consistent, For example, when the time limit for a court to seal a house has reached the registration authority, it must require the court to issue a notice of unseal. When handling mortgage registration, the registration authority must require the parties to determine whether the mortgage time has legal basis or not. Such problems, improper handling, will lead to administrative litigation, judicial confirmation, but also highlight the gaps in the law. Therefore, in this paper, the author intends to start from practice, try to explore some real estate registration process occurred in the error, and how to remedy the error after the occurrence, and how to deal with the situation without legal provisions? Try to put forward some of your own suggestions and ideas.
