借用文學(xué)作品人物角色創(chuàng)作的版權(quán)問題研究——美國判例研究的啟示

【摘要】:人物角色能否獨立于作品受到版權(quán)保護(hù)一直是司法實務(wù)界頗具爭議的問題。文學(xué)作品不同于美術(shù)和影視作品,其中的人物角色特征不能通過視覺感知而呈現(xiàn),無法展現(xiàn)出人物角色的鮮明特征,這就加深了文學(xué)作品中人物角色版權(quán)保護(hù)和侵權(quán)判定的難度。美國娛樂產(chǎn)業(yè)出現(xiàn)的比較典型的與人物角色有關(guān)的版權(quán)侵權(quán)案較多,而法官在判決時產(chǎn)生了幾種不同的保護(hù)思路和侵權(quán)判定方法。美國判例中的相關(guān)司法理念和方法,特別是在判定人物角色是否受版權(quán)保護(hù)、后續(xù)作品是否侵權(quán)中所采用的思路和方法,值得我國立法者、司法審判人員思考和借鑒。
[Abstract]:Whether characters can be protected by copyright independently of works has always been a controversial issue in judicial practice. Literary works are different from art and film works, in which the characters' characteristics can not be presented through visual perception and can not show the distinctive characteristics of the characters. This deepens the difficulty of copyright protection and infringement judgment of personas in literary works. There are more typical copyright infringement cases related to personas in the entertainment industry of the United States, and the judge has produced several different ways of protection and judgment of infringement. The relevant judicial concepts and methods in American jurisprudence, especially in judging whether the personas are protected by copyright and whether the subsequent works are infringed, are worthy of consideration and reference by our legislators and judicial judges.
