【摘要】：大數(shù)據(jù)的發(fā)展為個(gè)人生活、企業(yè)創(chuàng)新和國(guó)家治理都帶來(lái)了便利,但同時(shí)也為個(gè)人信息安全的保護(hù)帶來(lái)了新的挑戰(zhàn)。如何權(quán)衡好個(gè)人信息安全保護(hù)和個(gè)人信息自由流動(dòng)這兩方面的矛盾利益,考量著一國(guó)立法者的智慧。在個(gè)人信息立法保護(hù)方面,域外國(guó)家已然走在我國(guó)前面。我國(guó)現(xiàn)行的立法保護(hù)范圍狹窄、保護(hù)機(jī)制缺失、違法成本低下的情況已嚴(yán)重阻礙了大數(shù)據(jù)產(chǎn)業(yè)的發(fā)展,也使得個(gè)人信息的安全面臨危機(jī)。不論從個(gè)人層面亦或社會(huì)和國(guó)家層面,大數(shù)據(jù)時(shí)代完善我國(guó)立法對(duì)個(gè)人信息安全的保護(hù)已迫在眉睫。針對(duì)現(xiàn)行立法的缺漏,比對(duì)國(guó)外立法的模式,未來(lái)我國(guó)個(gè)人信息保護(hù)方面的立法應(yīng)當(dāng)從如下幾點(diǎn)來(lái)推進(jìn):完善現(xiàn)有的保護(hù)法規(guī),也即擴(kuò)大現(xiàn)有部門(mén)立法中對(duì)個(gè)人信息的保護(hù)范圍,讓政府部門(mén)、壟斷企業(yè)承擔(dān)更多的責(zé)任,完善侵犯?jìng)�(gè)人信息的違法責(zé)任;加快《個(gè)人信息保護(hù)法》的出臺(tái),以個(gè)人信息前置性法律來(lái)指引和協(xié)調(diào)現(xiàn)行個(gè)人信息的全部立法,從而達(dá)到對(duì)個(gè)人信息的系統(tǒng)性保護(hù)。
[Abstract]:The development of large data has brought convenience to personal life, enterprise innovation and national governance, but it also brings new challenges to the protection of personal information security. How to weigh the conflicting interests of the two aspects of personal information security protection and free flow of personal information, consider the wisdom of the legislator of a country. On the other hand, the foreign countries have already been in front of our country. Our current legislative protection scope is narrow, the protection mechanism is missing, and the low cost of law has seriously hindered the development of the big data industry, and the security of personal information is facing the crisis. No matter from the individual level or the social and national level, the large data age consummates our country legislation. The protection of personal information security is imminent. In view of the absence of current legislation, compared with the mode of foreign legislation, the legislation of personal information protection in the future of our country should be promoted from the following points: to improve the existing protection laws and regulations, that is to expand the scope of protection of the information of the individual in the existing department legislation, and let the government departments, monopolize the enterprises Take more responsibility, improve the illegal liability for personal information, speed up the introduction of the personal information protection law, guide and coordinate all the legislation of the current personal information with the prepositional law of personal information, so as to achieve the systematic protection of personal information.
