勞務(wù)派遣中的雇主替代責(zé)任研究

【摘要】:勞務(wù)派遣是一種最初表現(xiàn)為“人力租賃”,進(jìn)一步發(fā)展成為“借用雇員”,最后在我國被定名為“勞務(wù)派遣”的一種涉及到三方主體,即勞務(wù)派遣單位、被派遣勞動(dòng)者、接受被派遣勞動(dòng)者的單位的特殊的用工方式,其不同于一般的僅僅涉及兩方主體的雇傭關(guān)系。其具體指的是由勞務(wù)派遣機(jī)構(gòu)與被派遣的勞動(dòng)者訂立勞動(dòng)合同,然后將勞動(dòng)者派向其他用工單位,再由該實(shí)際用工單位向派遣機(jī)構(gòu)支付一筆服務(wù)費(fèi)用的一種用工形式。勞動(dòng)力給付的事實(shí)發(fā)生于被派遣的勞動(dòng)者與實(shí)際用工單位之間,實(shí)際用工單位向勞務(wù)派遣機(jī)構(gòu)支付服務(wù)費(fèi),勞務(wù)派遣機(jī)構(gòu)向被派遣的勞動(dòng)者支付勞動(dòng)報(bào)酬。勞務(wù)派遣最初出現(xiàn)在20世紀(jì)20年代的美國,隨后因?yàn)槠涑绦蚝唵、便于管理、符合?jīng)濟(jì)發(fā)展的特點(diǎn),在20世紀(jì)70年代得到世界上多個(gè)國家的廣泛運(yùn)用。20世紀(jì)90年代勞務(wù)派遣在我國勞動(dòng)力市場(chǎng)上的各個(gè)領(lǐng)域得到了廣泛的運(yùn)用,其對(duì)于推動(dòng)我國經(jīng)濟(jì)的發(fā)展以及勞動(dòng)者就業(yè)難問題的解決起到了不可缺少的作用。但是由于這種特殊的用工方式在我國發(fā)展的時(shí)間較短,人們對(duì)它的認(rèn)識(shí)較少,所以在我國有關(guān)于其的法律規(guī)定較少而且相關(guān)的法律規(guī)定較為粗疏,也因?yàn)榇诉M(jìn)一步導(dǎo)致了其在我國實(shí)踐中實(shí)施運(yùn)用的時(shí)候存在很多的問題。勞務(wù)派遣中的雇主替代責(zé)任是指當(dāng)被派遣的勞動(dòng)者在為接受被派遣勞動(dòng)者的單位工作的過程之中造成他人損害時(shí),勞務(wù)派遣單位、接受被派遣勞動(dòng)者的單位兩者作為被派遣勞動(dòng)者的兩個(gè)“雇主”應(yīng)該代替被派遣的勞動(dòng)者承擔(dān)侵權(quán)責(zé)任的問題。本文主要是通過文獻(xiàn)研究、比較研究、歸納解析等各種研究方法,對(duì)勞務(wù)派遣中雇主替代責(zé)任的基礎(chǔ)理論進(jìn)行分析,闡述了域外勞務(wù)派遣中雇主替代責(zé)任及對(duì)我國的借鑒意義,并分析了我國勞務(wù)派遣中雇主替代責(zé)任的立法現(xiàn)狀以及從《侵權(quán)責(zé)任法》的視角剖析立法存在的不足,最后提出我國勞務(wù)派遣中有關(guān)雇主替代責(zé)任的完善建議。從而為我國勞務(wù)派遣中雇主替代責(zé)任的立法完善出謀獻(xiàn)策,以促進(jìn)我國的勞動(dòng)力市場(chǎng)更加規(guī)范。本論題包括引言、正文五個(gè)部分以及結(jié)束語:引言部分,這個(gè)部分主要介紹了本論題的課題來源、課題研究的目的及意義、本論題的國內(nèi)外研究現(xiàn)狀、本論題的研究方法等內(nèi)容;正文第一部分,主要從勞務(wù)派遣概述、雇主替代責(zé)任概述、勞務(wù)派遣中三方法律關(guān)系辨析這三個(gè)方面簡要闡述了有關(guān)勞務(wù)派遣中雇主替代責(zé)任的基本理論;正文第二部分,主要從勞務(wù)派遣中雇主替代責(zé)任的理論基礎(chǔ)、勞務(wù)派遣中雇主替代責(zé)任的歸責(zé)原則這兩個(gè)方面對(duì)勞務(wù)派遣中雇主替代責(zé)任的理論基礎(chǔ)與歸責(zé)原則進(jìn)行了簡要的闡述;正文第三部分,主要闡述英國、法國、美國、我國臺(tái)灣地區(qū)有關(guān)勞務(wù)派遣中雇主替代責(zé)任的相關(guān)規(guī)定以及各個(gè)區(qū)域中雇主替代責(zé)任相關(guān)規(guī)定對(duì)于我國勞務(wù)派遣中雇主替代責(zé)任的借鑒意義;正文第四部分,主要是重點(diǎn)論述我國勞務(wù)派遣中雇主替代責(zé)任的立法現(xiàn)狀以及其在立法上存在的不足之處;正文第五部分,主要是以《侵權(quán)責(zé)任法》為視角,針對(duì)我國勞務(wù)派遣中雇主替代責(zé)任立法上的不足提出相對(duì)應(yīng)的完善建議,以至于我國有關(guān)勞務(wù)派遣中雇主替代責(zé)任的相關(guān)法律法規(guī)可以得到更好的完善,可以更好地促進(jìn)我國勞務(wù)派遣的發(fā)展;結(jié)束語部分,這個(gè)部分主要是對(duì)本論題進(jìn)行總結(jié)。
[Abstract]:Labor dispatch is a kind of special labor mode, which is different from the general one, which is first expressed as "human lease", and it is further developed into "borrowing employees", and in the end it is called "labor dispatch", which involves three parties, that is, the labor dispatch unit, the dispatched laborers, and the units that are sent to the dispatched workers. The employment relationship involving the two party body, which refers to a labor contract which is made by the labor dispatch agency and the dispatched worker, and then sends the labourer to other employment units, and then the actual employment unit pays a service fee to the dispatch agency. The facts of the labor power supply occur in the dispatched labor. Between the actual employment unit and the actual employment unit, the actual employment unit paid the service fee to the labor dispatch agency. The labor dispatch agency paid the labor remuneration to the dispatched workers. The labor dispatch was first appeared in the United States in 1920s, and then because of its simple procedure, easy management, the characteristics of economic development, and the world in 1970s. The extensive use of many countries in the world has been widely used in various fields in the labor market of China in the 90s.20 century. It has played an indispensable role in promoting the development of China's economy and the difficult problem of employment for workers. However, this special mode of employment has been developed in our country. Relatively short, people are less aware of it, so there are less laws and regulations about it in our country and the relevant legal provisions are relatively rough, because this further leads to the existence of many problems when it is applied in our country. The replacement responsibility of the employer in the labor dispatch refers to the acceptance by the dispatched workers for acceptance. In the course of the work of the dispatched workers, the labor dispatch unit and the unit of the dispatched workers, which accept the two "employers" of the dispatched workers, should replace the dispatched workers to take on the tort liability. This article is mainly through literature research, comparative research, induction and analysis and so on. The research method analyzes the basic theory of replacement responsibility of employers in labor dispatch, expounds the replacement responsibility of employers in the extraterritorial labor dispatch and the reference significance to our country, and analyzes the legislative status of the employer's replacement responsibility in our labor dispatch and analyzes the shortcomings of the legislation from the perspective of the tort liability law. Finally, I put forward that This thesis includes introduction, five parts of the text and the end: Introduction: this part mainly introduces the topic of this thesis. Source, the purpose and significance of the research, the current research situation at home and abroad, the research method of the thesis, and so on. The first part of the text, mainly from the summary of labor dispatch, the overview of the employer's replacement responsibility, and the analysis of the legal relations between the three parties in the labor dispatch, briefly expounds the basic theory of the employer's replacement responsibility in the labor dispatch; The second part of the text mainly expounds the theoretical basis and the principle of the replacement responsibility of employers in the two aspects of the replacement responsibility of the employer in the labor dispatch and the principle of the liability for the replacement of employers in the labor dispatch. The third part of the text mainly expounds the UK, France, the United States and the Taiwan land of our country. In the fourth part of the text, the fourth part of the text mainly discusses the legislative status of employer replacement responsibility in our labor dispatch and its shortcomings in legislation. The fifth part of the text is mainly based on the "tort liability law" as the angle of view, and puts forward the relative perfect suggestions on the shortage of employers' alternative responsibility in the labor dispatch of our country, so that the relevant laws and regulations about the replacement responsibility of employers in our labor dispatch can be better perfected, which can better promote the labor service school in our country. In the concluding part, this part mainly summarizes the topic.
