【摘要】：對于冷凍受精胚胎,將其作為客體物中的倫理物予以高規(guī)格的保護(hù)比較恰當(dāng)。作為倫理物的受精胚胎是介于人與物之間的過渡存在,具有孕育成生命的潛質(zhì),將其作為一般遺產(chǎn)繼承無法體現(xiàn)對生命的尊重,有違倫理要求,賦予相關(guān)權(quán)利人以監(jiān)管、處置權(quán)似乎更加合理。為防止因冷凍受精胚胎的處置引發(fā)糾紛,行政主管部門應(yīng)當(dāng)統(tǒng)一制定相關(guān)知情同意書的示范條款,完善各種情形下對冷凍受精胚胎的處置約定。其中,胚胎收養(yǎng)制度是各種處置方式中較優(yōu)的選擇。
[Abstract]:For frozen fertilized embryos, it is more appropriate to protect them as ethical objects in the object. As an ethical thing, the fertilized embryo is a transitional existence between people and things, which has the potential to breed into life. As a general inheritance, it cannot reflect the respect for life, which violates the ethical requirements and endows the relevant right holders with supervision. Disposition seems more reasonable. In order to prevent disputes arising from the disposal of frozen fertilized embryos, the administrative authorities should make a unified model clause of the relevant informed consent, and perfect the agreement on the disposal of frozen fertilized embryos under various circumstances. Among them, embryo adoption system is a better choice among all kinds of disposal methods.
