【摘要】：目前,WIPO組織推動(dòng)各國(guó)國(guó)內(nèi)版權(quán)立法保護(hù)民間文學(xué)藝術(shù)表達(dá)工作并未取得實(shí)質(zhì)性進(jìn)展,我國(guó)《民間文學(xué)藝術(shù)作品著作權(quán)保護(hù)條例》立法仍在困惑中進(jìn)行,是否需要對(duì)民間文學(xué)藝術(shù)表達(dá)進(jìn)行版權(quán)法保護(hù)以及選擇何種方式進(jìn)行保護(hù),是走出這一困境的關(guān)鍵問(wèn)題。厘清民間文學(xué)藝術(shù)表達(dá)與民間文學(xué)藝術(shù)作品的區(qū)別,明確非物質(zhì)文化遺產(chǎn)法公法手段與版權(quán)法私法手段的協(xié)調(diào),是走出民間文學(xué)藝術(shù)表達(dá)版權(quán)法保護(hù)困境的認(rèn)識(shí)基礎(chǔ);采取版權(quán)法并入模式而非特別權(quán)利保護(hù)模式,是推動(dòng)我國(guó)民間文學(xué)藝術(shù)表達(dá)版權(quán)法保護(hù)的合理路徑。
[Abstract]:At present, WIPO has not made substantial progress in promoting domestic copyright legislation to protect the expression of folklore, and the legislation on copyright protection of folklore works in our country is still being carried out in confusion. Whether it is necessary to protect the expression of folk literature and art by copyright law and how to protect it is the key problem to get out of this dilemma. To clarify the differences between the expression of folklore and the works of folklore, and to make clear the coordination between the means of public law and private law of immaterial cultural heritage law and the means of copyright law and private law, is the cognitive basis to get out of the dilemma of protecting the copyright law of expression of folk literature and art. It is a reasonable way to promote the protection of copyright law of folk literature and art expression in our country by adopting the mode of incorporation of copyright law rather than the mode of protection of special rights.
