【摘要】：正近年來隨著經(jīng)濟全球化的發(fā)展,國際民商事交往的日益增多,中國公民或與外國人結(jié)婚,或在國外擁有財產(chǎn),越來越多的公民選擇出國移民,由此導(dǎo)致我國繼承的涉外因素不斷增多,越來越多的繼承公證呈現(xiàn)出涉外因素。當繼承開始時,這些事實要件就要求相應(yīng)的沖突規(guī)范加以指引,以適用正確的準據(jù)法。涉外繼承公證由于自身的涉外因素,適用法律的過程復(fù)雜,辦證難度較大。但目前在公證理論界對涉外繼承公證的研究很少,公證立法中對此規(guī)
[Abstract]:In recent years, with the development of economic globalization and the increasing international civil and commercial exchanges, Chinese citizens either marry foreigners or own property abroad, and more and more citizens choose to emigrate abroad.As a result, the foreign-related factors of inheritance in China are increasing, and more and more notarization of inheritance presents foreign-related factors.At the beginning of succession, these factual elements require the corresponding conflict norms to apply the correct applicable law.Due to its foreign-related factors, the process of applying law is complicated and it is difficult to handle the notarization of foreign inheritance.However, there are few researches on foreign inheritance notarization in notarization theory, which is a rule in notarization legislation.
