【摘要】：由于我國侵權(quán)法律制度的建立時(shí)間尚短,導(dǎo)致很多問題在規(guī)定上尚不完善,特殊侵權(quán)責(zé)任之動物侵權(quán)責(zé)任的相關(guān)制度亦存在缺陷。本文對動物侵權(quán)責(zé)任的理論體系和具體規(guī)則作以闡述,并對《侵權(quán)責(zé)任法》的相關(guān)理念與規(guī)定進(jìn)行了深入分析,指出其在當(dāng)前法律實(shí)踐的過程中已經(jīng)顯露以及可能存在的問題,并針對所提問題對我國未來動物侵權(quán)領(lǐng)域立法的完善提出一些較為細(xì)致的具體建議,以期更好地保障動物侵權(quán)責(zé)任中各方民事主體的利益,為動物侵權(quán)責(zé)任制度的完善提供參考建議。本文論述動物侵權(quán)責(zé)任主要有以下四個(gè)方面:第一部分從動物的界定、責(zé)任性質(zhì)以及歸責(zé)原則三個(gè)方面對動物侵權(quán)責(zé)任的特殊性進(jìn)行了分析。正是動物侵權(quán)責(zé)任具有的特殊性,使它成為了一種特殊的侵權(quán)責(zé)任。第二部分對我國《侵權(quán)責(zé)任法》第十章中關(guān)于四種特殊動物的具體規(guī)定作出闡釋,包括違規(guī)飼養(yǎng)的動物之規(guī)定、禁止飼養(yǎng)的動物之規(guī)定、動物園飼養(yǎng)動物之規(guī)定以及遺棄、逃逸動物之規(guī)定,并提出了遺棄、逃逸動物之規(guī)定與其他三條規(guī)定在性質(zhì)上并不相同的觀點(diǎn)。第三部分探討了動物侵權(quán)責(zé)任在我國實(shí)踐中存在的問題�！肚謾�(quán)責(zé)任法》適用至今,在使用過程中顯現(xiàn)出一些問題,在責(zé)任主體、免責(zé)事由方面均存在爭議,并且存在無法適用于司法實(shí)踐的規(guī)定,同時(shí),《侵權(quán)責(zé)任法》缺少能夠適用于流浪動物侵權(quán)的規(guī)定或指引,導(dǎo)致流浪動物侵權(quán)案件救濟(jì)困難。第四部分對我國動物侵權(quán)責(zé)任制度的完善提出了建議。首先建議對動物侵權(quán)責(zé)任在民法典中進(jìn)行完善,并提出了動物侵權(quán)責(zé)任制度在具體設(shè)計(jì)上的建議。其次,針對流浪動物侵權(quán)案件救濟(jì)困難的問題,提出了用于解決這一問題的配套制度建議。
[Abstract]:Due to the short time of the establishment of tort legal system in China, many problems are not perfect in regulation, and the related system of animal tort liability for special tort liability also has defects.In this paper, the theoretical system and specific rules of animal tort liability are expounded, and the related concepts and regulations of Tort liability Law are analyzed in depth. It is pointed out that the Tort liability Law has been exposed in the process of current legal practice and the possible problems.In order to better protect the interests of the civil subjects in animal tort liability, the author puts forward some detailed and concrete suggestions on the perfection of the legislation in the field of animal tort in the future of our country, in order to better protect the interests of the various civil subjects in animal tort liability.To provide reference for the improvement of animal tort liability system.This article discusses the animal tort liability mainly has the following four aspects: the first part has carried on the analysis from the animal definition, the responsibility nature and the imputation principle three aspects to the animal tort liability particularity.It is the particularity of animal tort liability that makes it a special tort liability.The second part explains the specific provisions of Chapter 10 of our country's Tort liability Law concerning four special animals, including the provisions on animals that are not allowed to be kept, the provisions on animals prohibited from breeding, the provisions on keeping animals in zoos, and the provisions on abandonment,The rules of escaping animals are different in nature from those of the other three provisions.The third part discusses the problems existing in the practice of animal tort liability in our country. The Tort liability Law has been applied up to now, and some problems have appeared in the process of use, and there are disputes on the subject of liability and the reason of exemption.At the same time, the Tort liability Law lacks the provisions or guidelines that can be applied to the torts of stray animals, which leads to the difficulty of relief in the cases of torts of stray animals.The fourth part puts forward some suggestions on the perfection of animal tort liability system in China.Firstly, the author suggests that animal tort liability should be perfected in the Civil Code, and puts forward some suggestions on the concrete design of animal tort liability system.Secondly, in view of the difficulty of relief in the torts of stray animals, the paper puts forward the corresponding system suggestions to solve this problem.
