【摘要】：同一申請人同日對同樣的發(fā)明創(chuàng)造既申請實用新型專利又申請發(fā)明專利時,如果任意一份請求書遺漏同日聲明或者任意一份專利申請文件出現(xiàn)缺陷,將導(dǎo)致申請人的專利權(quán)范圍受到影響甚至無法獲得授權(quán)。為了最大限度地減少申請人的權(quán)利損失,除了需要申請人和代理人提交之前認(rèn)真仔細(xì)審對,發(fā)現(xiàn)缺陷及時準(zhǔn)確補(bǔ)救之外,更需要從源頭來杜絕這種情況,即對同日申請發(fā)明和實用新型的提交流程進(jìn)行優(yōu)化。本文首先概述了在現(xiàn)有提交流程中容易出現(xiàn)的缺陷及其克服方法,其次針對同日提交發(fā)明和實用新型的紙件申請流程提出優(yōu)化方案,再次針對同日提交發(fā)明和實用新型的電子申請流程提出優(yōu)化方案,最后對優(yōu)化方案進(jìn)行可行性分析和推行前景展望,供廣大同仁批評指正。
[Abstract]:When the same applicant applies for a utility model patent and an invention patent for the same invention on the same day, if any one of the requests omits the declaration of the same date or any one of the patent application documents is defective,Will result in the scope of the applicant's patent affected or even unable to obtain authorization.In order to minimize the loss of rights of the applicant, in addition to the need for the applicant and the agent to carefully examine the situation before submitting it, and to find that the defects are promptly and accurately remedied, it is also necessary to put an end to this situation from the source.In other words, the submission process of the same day application for invention and utility model is optimized.In this paper, the defects that are easy to appear in the present submission process and the methods to overcome them are summarized, and then the optimization scheme for the paper application process of the invention and utility model submitted on the same day is put forward.Finally, the optimization scheme is put forward for the electronic application flow of the invention and utility model submitted on the same day. Finally, the feasibility analysis and prospect of the optimization scheme are carried out, which can be criticized and corrected by many colleagues.
