【摘要】：網(wǎng)絡(luò)游戲畫面包括游戲開發(fā)設(shè)計(jì)所形成的網(wǎng)絡(luò)游戲畫面、玩家操作所形成的網(wǎng)絡(luò)游戲畫面、直播平臺(tái)錄制及大型電子競技賽事主辦方所制作的網(wǎng)絡(luò)游戲直播畫面或節(jié)目,不同語境下的網(wǎng)絡(luò)游戲畫面涉及不同層面的法律問題,對這些法律問題,學(xué)理和實(shí)踐上尚未形成共識。尤其是網(wǎng)絡(luò)游戲畫面自身可否構(gòu)成作品,玩家操作所形成的網(wǎng)絡(luò)游戲畫面是否具有獨(dú)創(chuàng)性,網(wǎng)絡(luò)游戲直播所形成的網(wǎng)絡(luò)游戲直播畫面是否可以獲得著作權(quán)的保護(hù)等問題,爭議較大。在網(wǎng)絡(luò)游戲直播過程中,為平衡網(wǎng)絡(luò)游戲開發(fā)者、直播平臺(tái)、游戲玩家等諸多主體之間的利益,需要在著作權(quán)法的視野下審視不同網(wǎng)絡(luò)游戲畫面的法律意義,并通過著作權(quán)法的修改厘清各方主體的權(quán)利義務(wù)關(guān)系。
