【摘要】：網(wǎng)絡(luò)信息資源的聚合技術(shù)與服務(wù)已經(jīng)成為國(guó)內(nèi)研究前沿的熱點(diǎn)。新技術(shù)的產(chǎn)生有可能會(huì)改變既有法律框架下的權(quán)益平衡,因而使相關(guān)權(quán)利主體在權(quán)責(zé)界定上產(chǎn)生爭(zhēng)議,因此,本文結(jié)合案例、法律以及相關(guān)討論,在聚合行為解構(gòu)的基礎(chǔ)上,探討聚合過程中的關(guān)鍵技術(shù)是否存在侵權(quán)風(fēng)險(xiǎn),討論主要從以下幾點(diǎn)展開:(1)超鏈接是否構(gòu)成信息網(wǎng)絡(luò)傳播權(quán)侵權(quán);(2)摘要、圖片是否構(gòu)成復(fù)制權(quán)侵權(quán);(3)聚合結(jié)果是否構(gòu)成改編權(quán)、演繹權(quán)侵權(quán);(4)內(nèi)容聚合是否涉及不正當(dāng)競(jìng)爭(zhēng)四個(gè)方面。最后,討論了在現(xiàn)有的法律框架下,可以采取法律授權(quán)途徑、合同授權(quán)途徑和系統(tǒng)管理途徑三個(gè)方面進(jìn)行著作權(quán)的侵權(quán)風(fēng)險(xiǎn)規(guī)避,并就完善與聚合系統(tǒng)相關(guān)的著作權(quán)制度提出建議。
[Abstract]:The converging technology and service of network information resources have become the hot spot of domestic research.The emergence of new technology is likely to change the balance of rights and interests under the existing legal framework, so that the relevant subjects of rights and responsibilities in the definition of rights and responsibilities are controversial. Therefore, this paper combines cases, laws and related discussions, on the basis of the deconstruction of the aggregation act.This paper probes into whether the key technology in the process of aggregation has the risk of infringement, and discusses whether the hyperlink constitutes the infringement of the right of communication of information network and whether the picture constitutes the infringement of the right of reproduction. (3) whether the result of aggregation constitutes the right of adaptation, and whether the hyperlink constitutes the infringement of the right of communication of the information network.Deductive right infringement (4) whether the aggregation of content involves unfair competition in four aspects.Finally, under the existing legal framework, the author discusses how to avoid the infringement risk of copyright in three aspects: legal authorization, contract authorization and system management.Some suggestions on how to perfect the copyright system related to aggregation system are put forward.
