【摘要】:創(chuàng)意產(chǎn)業(yè)是一種以文化為內(nèi)涵、以創(chuàng)造為核心的新型產(chǎn)業(yè)。創(chuàng)意產(chǎn)業(yè)因其創(chuàng)新性,占據(jù)產(chǎn)業(yè)價(jià)值鏈頂端,帶動(dòng)其他相關(guān)產(chǎn)業(yè),為整個(gè)經(jīng)濟(jì)環(huán)境的整體發(fā)展提供巨大的推動(dòng)力。其創(chuàng)新性、高附加值、強(qiáng)滲透力、技術(shù)高精尖以及輻射力強(qiáng)的特征,有力地推動(dòng)了我國(guó)的產(chǎn)業(yè)結(jié)構(gòu)優(yōu)化升級(jí),進(jìn)而提升了我國(guó)在國(guó)際上的綜合競(jìng)爭(zhēng)實(shí)力,改變我國(guó)在國(guó)際價(jià)值體系中的低端環(huán)節(jié)位置,將發(fā)揮越來(lái)越重要的作用。唯有加強(qiáng)知識(shí)產(chǎn)權(quán)保護(hù),充分保障好創(chuàng)意主體的切身權(quán)益,繼續(xù)進(jìn)行創(chuàng)新活動(dòng),才可以確保創(chuàng)意產(chǎn)業(yè)的可持續(xù)發(fā)展。創(chuàng)意產(chǎn)業(yè)在我國(guó)的發(fā)展比較之后,出現(xiàn)的時(shí)間較晚,創(chuàng)意產(chǎn)業(yè)作為一種新型產(chǎn)業(yè),對(duì)其知識(shí)產(chǎn)權(quán)保護(hù)方面的研究仍處于初級(jí)階段。本文主要分析我國(guó)創(chuàng)意產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)保護(hù)中存在缺乏健全的法律法規(guī)、管理行政體制不健全、品牌意識(shí)淡薄、缺乏保護(hù)意識(shí)等問(wèn)題,嘗試創(chuàng)意產(chǎn)業(yè)價(jià)值鏈的角度出發(fā),《喜羊羊與灰太狼》在我國(guó)可以稱之為創(chuàng)意產(chǎn)業(yè)的成功典型之一,本論文以該案例為研究對(duì)象,對(duì)創(chuàng)意產(chǎn)業(yè)價(jià)值鏈中知識(shí)產(chǎn)權(quán)表現(xiàn),以及從構(gòu)思、開發(fā)、營(yíng)銷、消費(fèi)階段各環(huán)節(jié)知識(shí)產(chǎn)權(quán)保護(hù)策略進(jìn)行了全面地分析。最后,以產(chǎn)業(yè)價(jià)值鏈為切入點(diǎn),向政府、企業(yè)提供了一些發(fā)展創(chuàng)意產(chǎn)業(yè)和保護(hù)知識(shí)產(chǎn)權(quán)方面的一些好的建議和意見。
[Abstract]:Creative industry is a new industry with culture as its connotation and creation as its core.Creative industry, because of its innovation, occupies the top of the industrial value chain, drives other related industries, and provides a huge impetus for the overall development of the entire economic environment.Its characteristics of innovation, high added value, strong permeability, high technological sophistication and strong radiating power have powerfully promoted the optimization and upgrading of China's industrial structure, thus enhancing our country's comprehensive competitive strength in the international arena.Changing our country's position in the low end of the international value system will play a more and more important role.Only by strengthening the protection of intellectual property rights, fully protecting the personal rights and interests of creative subjects, and continuing to carry out innovative activities, can the sustainable development of creative industries be ensured.After the development of creative industry in China, it appeared later. As a new type of industry, the research on intellectual property protection of creative industry is still in the primary stage.This paper mainly analyzes the lack of sound laws and regulations in the protection of intellectual property rights of creative industries in China, the unsound administrative system of management, the weak brand awareness, the lack of awareness of protection, and so on.From the point of view of trying creative industry value chain, "Happy Sheep and Grey Wolf" can be called one of the successful examples of creative industry in our country. This paper takes this case as the research object, and shows the intellectual property right in the creative industry value chain.And from the conception, development, marketing, consumption stages of intellectual property protection strategies for a comprehensive analysis.Finally, with the industrial value chain as the starting point, some good suggestions and suggestions on developing creative industries and protecting intellectual property rights are provided to the government and enterprises.
