【摘要】：對民事習慣的認可在民法典編纂中具有重要意義,需要從規(guī)范層面更加具體而審慎地分析。民事習慣的實踐是復(fù)雜的,可分為三種:涉及民事主體個人利益的民事習慣、涉及自治團體利益的民事習慣以及涉及社會公共利益的民事習慣。對這三種狀態(tài)的民事習慣應(yīng)采取不同的認可模式。根據(jù)民法理論,對民事習慣的認可在規(guī)范上分別表現(xiàn)為補充性的任意性規(guī)范、解釋性的任意性規(guī)范和強制性規(guī)范三種形式。而在規(guī)范語詞的選擇上,三種規(guī)范都應(yīng)采用"應(yīng)當"一詞。對民事習慣的認可并不意味著對其放任,這需要禁止性規(guī)范來對其限制。
[Abstract]:The recognition of civil custom is of great significance in the codification of civil code, which needs to be analyzed more concretely and carefully from the normative level.The practice of civil custom is complicated and can be divided into three types: the civil custom involving the individual interests of the civil subject, the civil custom involving the interests of autonomous groups and the civil custom involving the public interest of the society.The civil custom of these three states should adopt different approbation mode.According to the theory of civil law, the acceptance of civil custom is manifested in three forms: supplementary arbitrary norm, interpretive arbitrariness norm and compulsory norm.In the choice of normative words, all three kinds of norms should adopt the word "shall".Recognition of civil custom does not mean laissez-faire, which requires prohibitive norms to restrict it.
