【摘要】：改革開放以來(lái),旅游業(yè)高速發(fā)展,逐漸在國(guó)民經(jīng)濟(jì)發(fā)展中占據(jù)了舉足輕重的地位,特別是近十年來(lái),行業(yè)規(guī)模不斷擴(kuò)大,從業(yè)人員不斷增加,經(jīng)營(yíng)體制不斷創(chuàng)新,經(jīng)營(yíng)環(huán)境不斷改善,旅游業(yè)已經(jīng)成為我國(guó)拉動(dòng)經(jīng)濟(jì)增長(zhǎng)、擴(kuò)大就業(yè)渠道的重要的服務(wù)行業(yè)之一。但是由于各種因素的共同作用,當(dāng)前旅游業(yè)存在不少損害消費(fèi)者權(quán)益的現(xiàn)象。實(shí)際上,由于旅游合同糾紛的證據(jù)難以保全,加上救濟(jì)權(quán)利的過程耗時(shí)耗力,旅游消費(fèi)者往往在維權(quán)的過程中障礙重重。所以很大一部分的旅游消費(fèi)者選擇忍氣吞聲,但是這種軟弱更加劇了旅游經(jīng)營(yíng)者愈發(fā)沒有節(jié)制的侵權(quán)行為。在這些侵權(quán)行為中,影響最惡劣的當(dāng)屬“零負(fù)團(tuán)費(fèi)”游。所謂“零負(fù)團(tuán)費(fèi)”,即旅行社會(huì)以極低的價(jià)格誘惑消費(fèi)者參加旅行團(tuán),在合同中抬高旅游服務(wù)、虛構(gòu)旅游項(xiàng)目的價(jià)格,更甚者會(huì)對(duì)旅游消費(fèi)者進(jìn)行威脅并強(qiáng)制其消費(fèi)。消費(fèi)者出于多種原因,往往在當(dāng)時(shí)都會(huì)陷入難以維權(quán)的地步。長(zhǎng)此以往,這種現(xiàn)象必將嚴(yán)重打擊旅游消費(fèi)者的積極性,對(duì)整個(gè)旅游行業(yè)的健康發(fā)展都產(chǎn)生極為不利的影響。本文會(huì)從“零負(fù)團(tuán)費(fèi)”游的形成原因入手,剖析這一違法現(xiàn)象的形式以及對(duì)旅游消費(fèi)者權(quán)益的損害,指出我國(guó)目前對(duì)“零負(fù)團(tuán)費(fèi)”游法律規(guī)制的不足并對(duì)旅游消費(fèi)者權(quán)益的法律保護(hù)提出建議。
[Abstract]:Since the reform and opening up, tourism has been developing at a high speed and has gradually occupied a pivotal position in the development of the national economy. Especially in the past ten years, the scale of the industry has been continuously expanded, the number of employees has been increasing, and the operating system has been innovated.With the continuous improvement of business environment, tourism has become one of the most important service industries to stimulate economic growth and expand employment channels.However, due to the joint action of various factors, the current tourism industry has a lot of damage to consumer rights and interests.In fact, because the evidence of tourism contract disputes is difficult to preserve, and the process of relief rights is time-consuming and exhausting, tourism consumers often have many obstacles in the process of safeguarding their rights.So a large proportion of tourist consumers choose to swallow up, but this weakness exacerbates the increasingly uncontrolled infringement of tourism operators.In these tort, the worst impact is the "zero negative group fee" tour.The so-called "zero negative group fee" means that travel agencies will entice consumers to join tour groups at extremely low prices, raise the prices of travel services in contracts, and make fictitious travel items more expensive, even more threatening to consumers and forcing them to spend.Consumers for a variety of reasons, often at that time will be difficult to defend the situation.In the long run, this phenomenon will seriously dampen the enthusiasm of tourism consumers and have a very negative impact on the healthy development of the whole tourism industry.This article will start with the forming reason of "zero negative group fee" tour, analyze the form of this illegal phenomenon and the damage to the tourist consumer's rights and interests.This paper points out the deficiency of legal regulation of "zero negative group fee" in our country and puts forward some suggestions on the legal protection of tourist consumers' rights and interests.
