【摘要】：民法上和解合同的客體范圍對民法上和解合同制度的完善有著重要的意義,同時也是各國立法與學理中具有爭議的一個問題。民法上和解合同的歷史源流以及其與相似概念的辨析,論證了民法上和解合同以爭執(zhí)的存在為前提。權利實現與否不確定之情形對應的為明確的無爭執(zhí)的法律關系,防止爭執(zhí)發(fā)生之情形對應的為將來發(fā)生爭執(zhí)的法律關系,這兩種情況都不應當納入民法上和解合同的客體范圍。民法上和解合同的客體范圍應當為"終止爭執(zhí)"。此處的爭執(zhí),一方面指當事人互為對立主張的法律關系之爭執(zhí),另一方面指非法律關系直接對立但有爭議而導致的法律關系不明確之情形。
[Abstract]:The object scope of the settlement contract in the civil law is of great significance to the perfection of the settlement contract system in the civil law. At the same time, it is also a controversial issue in the legislation and theory of various countries. It is demonstrated that in civil law, the existence of disputes is the premise of the settlement contract. The legal relationship corresponding to the uncertainty of the realization of rights is a clear and non-disputable legal relationship, and the one corresponding to the situation of preventing disputes is the legal relationship of future disputes. Neither of these two cases should be brought into the scope of the object of the settlement contract in the civil law. The object scope of the settlement contract in the civil law should be "terminating the dispute". On the other hand, the non-legal relationship is directly opposite but controversial and the legal relationship is not clear.
