【摘要】：實踐中,因醫(yī)療美容而導致的損害賠償糾紛往往被歸類為一般的醫(yī)療損害糾紛,而忽略了醫(yī)療美容自身的特殊性。醫(yī)療美容與傳統(tǒng)醫(yī)療之間都以醫(yī)療為介質,兩者之間有聯系點,但是,雙方的相異點更加值得關注。一味地把醫(yī)療美容損害歸類于一般的醫(yī)療損害,不僅不利于醫(yī)療美容行業(yè)的發(fā)展,更重要的是不利于保護接受醫(yī)療美容者的權益。本文立足于醫(yī)療美容與傳統(tǒng)醫(yī)療的相異點,從我國大陸地區(qū)法律適用方面著手,結合法院實際案例,分析當今醫(yī)療美容救濟體系的不足,同時,通過比較法研究,借鑒其他國家和地區(qū)先進理念,試圖對我國醫(yī)療美容損害責任作一些新的分析與理解。
[Abstract]:In practice, compensation disputes caused by medical beauty are often classified as general medical injury disputes, but the particularity of medical beauty itself is ignored. Medical treatment is the medium between medical beauty and traditional medical treatment. There is a link between the two, but the differences between the two sides are more worthy of attention. Blindly classifying medical beauty damage to general medical damage is not only detrimental to the development of the medical and beauty industry. What is more important is that it is not conducive to the protection of the rights and interests of those who receive medical beauty. Based on the differences between medical beauty and traditional medical care, this paper begins with the application of law in mainland China and combines the actual court cases. This paper analyzes the deficiency of medical beauty relief system at present, and tries to make some new analysis and understanding of medical beauty damage liability in our country by means of comparative study and drawing lessons from the advanced concepts of other countries and regions.
