【摘要】：2014年3月15日,新修訂的《消費(fèi)者權(quán)益保護(hù)法》正式實(shí)施,為進(jìn)一步保護(hù)消費(fèi)者的合法權(quán)益該法確立了"后悔權(quán)"制度。然而,大量增長的相關(guān)消費(fèi)投訴也隨之而來。文章結(jié)合當(dāng)前網(wǎng)購的特性,對新消法中"后悔權(quán)"適用的例外情況、后悔期間、保管義務(wù)和運(yùn)費(fèi)承擔(dān)幾個方面進(jìn)行分析,為全面完善網(wǎng)購"后悔權(quán)"制度提出合理建議。
[Abstract]:On March 15, 2014, the newly amended Consumer Rights and interests Protection Act came into effect, establishing a "right of regret" system for the further protection of the legitimate rights and interests of consumers. A large number of related consumer complaints have followed. This article, in combination with the characteristics of current online shopping, analyzes the exceptions to the application of the "right of regret" in the new law, as well as the obligations of custody and the bearing of freight charges during the period of regret. In order to improve the online purchase of "regret right" system to put forward reasonable suggestions.
