【摘要】:隨著金融管制體制日臻完善,金融消費(fèi)者權(quán)益保護(hù)作為消費(fèi)者概念在金融領(lǐng)域的延伸,越來(lái)越引起高度重視。尤其是美國(guó)金融危機(jī)爆發(fā)以后,全球各國(guó)金融監(jiān)管改革無(wú)不將金融消費(fèi)者保護(hù)提到前所未有的高度,世界各國(guó)一致認(rèn)為金融消費(fèi)者權(quán)益保護(hù)不到位是導(dǎo)致金融危機(jī)爆發(fā)的重要原因。金融消費(fèi)者權(quán)益保護(hù)關(guān)系到金融業(yè)能否實(shí)現(xiàn)健康快速發(fā)展,它與整個(gè)金融體系的安全、穩(wěn)定、高效運(yùn)行密切相關(guān)。從1978年開(kāi)始,我國(guó)政府對(duì)于金融的管理以及宏觀調(diào)控能力逐漸加強(qiáng)�?墒�,如果和歐美國(guó)家比較,國(guó)內(nèi)金融消費(fèi)者權(quán)益的保護(hù)仍相對(duì)欠缺,具體表現(xiàn)在法律法規(guī)以及監(jiān)管體系等方面。2014年3月15日正式實(shí)施的新消費(fèi)者權(quán)益保護(hù)法將金融消費(fèi)者權(quán)益保護(hù)納入監(jiān)管范圍。對(duì)擁有維護(hù)金融穩(wěn)定和改善金融市場(chǎng)服務(wù)重要職責(zé)的人民銀行而言,維護(hù)金融消費(fèi)者合法權(quán)益義不容辭。為進(jìn)一步適應(yīng)金融消費(fèi)者權(quán)益保護(hù)的新形勢(shì),中國(guó)人民銀行的基層行按照2013年5月出臺(tái)的《中國(guó)人民銀行金融消費(fèi)者權(quán)益保護(hù)工作管理辦法(試行)》規(guī)定,積極創(chuàng)新,努力探索,在維護(hù)金融消費(fèi)者權(quán)益方面取得了階段性成果。濱州市人民銀行成立了專(zhuān)門(mén)的消費(fèi)者保護(hù)協(xié)會(huì),同時(shí)不斷完善保護(hù)制度,努力尋求維護(hù)消費(fèi)者權(quán)益的新途徑。本文闡述我國(guó)開(kāi)展金融消費(fèi)者權(quán)益保護(hù)工作的重要意義,并從金融交易的供給方、需求方、監(jiān)管方三個(gè)角度對(duì)中外理論研究成果進(jìn)行了梳理,借鑒美、英、日等發(fā)達(dá)國(guó)家的消費(fèi)者權(quán)益保護(hù)的實(shí)踐經(jīng)驗(yàn),結(jié)合2014年濱州市消費(fèi)者權(quán)益保護(hù)情況,著重分析濱州市金融消費(fèi)者權(quán)益保護(hù)的現(xiàn)狀、投訴咨詢特點(diǎn)以及銀行卡類(lèi)、征信類(lèi)等不同類(lèi)型案例,剖析問(wèn)題產(chǎn)生的原因,從健全法律制度、完善監(jiān)管機(jī)構(gòu)框架、加強(qiáng)金融消費(fèi)者教育等不同角度,對(duì)維護(hù)金融消費(fèi)者權(quán)益提出工作思路,以期促進(jìn)金融消費(fèi)者權(quán)益保護(hù)制度不斷完善。
[Abstract]:With the improvement of the financial regulation system, the financial consumer rights and interests protection, as an extension of the consumer concept in the financial field, has attracted more and more attention, especially since the outbreak of the financial crisis in the United States. Financial regulatory reforms around the world have brought financial consumer protection to an unprecedented high. Countries all over the world agree that inadequate protection of the rights and interests of financial consumers is an important reason leading to the outbreak of the financial crisis. The protection of the rights and interests of financial consumers is related to whether the financial industry can achieve healthy and rapid development, and it is safe and stable with the entire financial system. Efficient operation is closely related. Since 1978, our government has gradually strengthened its financial management and macro-control capabilities. However, if compared with European and American countries, the protection of domestic financial consumers' rights and interests is still relatively lacking. On March 15, 2014, the new law of consumer rights and interests protection will be included in the scope of supervision. To maintain financial stability and improve the financial market. For the people's Bank of China, which plays an important role in service, In order to further adapt to the new situation of protecting the rights and interests of financial consumers, it is incumbent upon them to safeguard their legitimate rights and interests. The grassroots banks of the people's Bank of China, in accordance with the regulations of the people's Bank of China on the Administration of Financial Consumer Rights and interests Protection (for trial implementation) promulgated in May 2013, actively innovate and make efforts to explore, In safeguarding the rights and interests of financial consumers, the Binzhou Municipal people's Bank established a special consumer protection association and constantly improved the protection system. Try to find a new way to safeguard the rights and interests of consumers. This paper expounds the importance of developing the protection of the rights and interests of financial consumers in China, and from the supply-side and demand-side aspects of financial transactions, Regulators have combed the theoretical research results of China and foreign countries from three angles, drawing lessons from the practical experience of consumer rights and interests protection in developed countries such as the United States, Britain and Japan, and combining with the situation of consumer rights and interests protection in Binzhou City in 2014. Focusing on the analysis of the current situation of financial consumers' rights and interests protection in Binzhou, the characteristics of complaint consultation and different types of cases, such as bank cards, credit information, etc., the causes of the problems are analyzed, and the legal system is improved and the regulatory framework is improved. In order to improve the system of protecting financial consumers' rights and interests, this paper puts forward some ideas on how to protect the rights and interests of financial consumers from different angles such as strengthening financial consumers' education.
